, t <br />CITY OF NORTH OLMSTED <br />"TOGETHER WE CAN MAKE A DIFFERENCE" <br />BOARD OF ZONING APPEALS <br />MINUTES - APRIL 3, 2003 <br />I. ROLL CALL: <br />Chairman Maloney called the meeting to order at 7: 30 p.m. <br />PRESENT: <br />Chairman J. Maloney; Board members J. Konold, W. Kremzar, N. Sergi, and T. Kelly <br />ALSO PRESENT: <br />Assistant Law Director B. O'Malley, Assistant Building Commissioner T. Rymarczyk, and Clerk of <br />Commissions D. Rote. <br />H. REVIIEW AND CORRECTION OF MINUTES: <br />The Board of Zoning Appeals minutes of March 6, 2003 have been submitted for approval. <br />J. Konold motioned to approve the March 6, 2003 minutes as submitted. W. Kremzar <br />seconded the motion, which was unanimously approved. Chairman Maloney indicated there are 6 cases requesting 7 variances. The Chairman advised that <br />the board members have viewed the premises involved for each case. Three votes are required for <br />approval. In addition each case will be judged on the physical situation peculiar to itself, so that in <br />no way is a judgment rendered considered to be a general policy judgment affecting properties and <br />like situations elsewhere. <br />M. BUILDING DEPARTMENT REQUESTS: <br />1. Joseqh & Joan Ehrbar, 23910 Vincent Drive, Ward 2: <br />Request for variance (1123.12). The proposal consists of a new front porch. <br />The following variance is requested: <br />1. An 8 foot variance for front yard setback (code requires 50 feet, applicant shows 42 feet). <br />Which is in violation of Ord. 90-125 section (1135.06 (a)). <br />Chairman Maloney called all interested parties forward to review their request. Mrs. Ehrbar <br />the owner came forward to be sworn in and address her request. Mrs. Ehrbar reviewed that <br />they would like a front porch with a roof for their home but the existing home sits at 50-feet <br />without the additional porch. Mr. Kremzar questioned if the existing porch would remain. <br />Mrs. Ehrbar indicated that it would be incorporated into the new porch. No further comments <br />were made. <br />J. Konold motioned to grant Joseph & Joan Ehrbar of 23910 Vincent Drive their request <br />for variance (1123.12) which consists of a new front porch and that the following variance <br />is granted: 1. An 8 foot variance for front yard setback (code requires 50', applicant shows <br />42'). Which is in violation of Ord. 90-125 section (1135.06 (a)). N. Sergi seconded the <br />motion, which was unanimously approved. Variance Granted. <br />2. John & Christine Hoffa, 30000 Westminster Drive, Ward 3: <br />Request for variance (1123.12). The proposal consists of a new accessory building (shed). <br />The following variance is requested: <br />1. A 5 foot variance for shed placement from rear property line (code requires 10 ft., applicant <br />shows 5 ft.), which is in violation of Ord. 90-125 section (1135.02 (d)(4)). <br />Note: Previously approved by the Board of Zoning Appeals 7/1/99. <br />Chairman Maloney called all interested parties forward to review their request. Mrs. Hoffa <br />the owner came forward to be sworn in and address the request. Mr. Maloney, reviewed that
