ROLL CALL: <br />Chairman Puzzitiello called the meeting to order at 5:30 p.m. <br />PRESENT: R. Puzzitiello, P. Engoglia, N. Althen,.M. Conway <br />ALSO PRESENT: Asst. Law Director B. O'Malley, Building Commissioner D. <br />Conway <br />II. REVIEW AND CORRECTION OF MINUTES: <br />The Board of Building Code Appeals minutes for November 18, 2004 are submitted <br />for approval. <br />M. Conway motioned to accept the minutes as submitted. P. Engoglia seconded <br />the motion. <br />III. Old Business: <br />Theresa Krvsiak, 4170 Columbia Road, VVRD 1: <br />Pursuant to Section 1331.05, Building Coinmissioner Conway has referred the order <br />to demolish 4170 Columbia Road structures to the Board of Building Code Appeals. <br />For confirmation that a public nuisance does exist and that failure of the owner or <br />parties of interest to demolish the structure shall cause the same to be abated by the <br />city upon being directed to do so by Council, in accordance with all the regulations <br />and requirements of Section 1331.05. Note: This proposal was tabled by the Board <br />of Building Code Appeals on September 16, 2004 and November 18, 2004. <br />Mr. Conway indicated that there is sufficient evidence that has been presented that <br />indicates the building is unsafe and damage exceeds 50% and needs to be demolished. <br />He further stated there is no way to renovate this structure. Mr. Engoglia agreed. <br />? <br />? <br />Mr. O'Malley said this proposal has beeri preserited before the Board numerous times <br />since September. The applicant has never shown up for a meeting. Mr. O'Malley <br />said the Building Commissioner sent a letter to the applicant ordering thein to <br />demolish the structure and they have failed to comply with that order. Mr. Conway <br />received a letter from the applicant asking for an extension, however, that was over <br />two months ago. The Board was presented with an order dated May 17tl' from Mr. <br />Conway informing them that the structure, is unsafe and should have it demolished. <br />Mr. Engoglia said that since there ;has;been'. ample evidence,through the building <br />department and architects, the Board should vote on demolition this evening. After <br />loolcing at the house, the Board agreed that it is unsafe. Mr. O'Malley agrees and <br />wants to assure that the record reflects all the photographs and testimony including <br />the October 26t' report done by Mr. Grussenmeyer and the health report by Mr. <br />,:
