ROLL CALL: <br />Chairman Puzzitiello called the meeting to order at 5:30 p.m. <br />PRESENT: Chairman Puzzitiello, M. Conway, P. Engoglia, N. Althen <br />ALSO PRESENT: Tom Rymarczyk, Asst. Building Commissioner and Planriing <br />Secretary L. McNabb <br />ABSENT: Asst. Law Director O'Malley <br />II. REVIEW AND CORRECTION OF MINUTES: <br />The Board of Building Code Appeals minutes for September 16th, 2004 are submitted <br />for approval. <br />P. Engoglia moved to approve the September 16, 2004 Board of Building Code <br />Appeal minutes as written. N. Althen seconded the motion, which was <br />unanimously approved. <br />III. OLD BUSINESS: <br />IV. NEW BUSINESS: <br />Theresa Krvsiak, 4170 Columbia Road WRD 1: <br />Pttrsuant to Section 1331.05, Building Commissioner Conway has referred the order <br />to demolish 4170 Columbia Road structures to the Board of Building Code Appeals. For <br />conformation that a public nuisance does exist and that failure of the owner or parties of <br />interest to demoiish the structure shall cause the same to be abated by the city upon <br />being directed to do so by Council, in accordance with all the regulations and <br />requirements of Section 1331.05. Note: This proposal was tabled by Board of <br />Building Code Appeals on September 16, 2004. <br />P. Engoglia moved to table this proposal until the next meeting. According to the <br />building department, the applicant will have the structural or sanitary engineer <br />reports available at the next meeting. M. Conway seconded, which was <br />unanimously approved. <br />Robert & Kimberlv Gabele, 26567 Waterburv Circle, WRD 1: <br />Fence already is installed along property line in the rear yard. 69' of fence with gate <br />to be installed along rear property line. This is in violation of building code section <br />1369.03. <br />The applicant who had just moved into their home is requesting that a 69' fence be <br />installed in the back of their property. There is a 10' CEI easement, 5' on each person's <br />property. The City does not allow that two fences be parallel to each other. However, <br />the applicant stated they would install a gate that would allow access to the area between <br />their fence and Mr. Campo's residence, who is the Fairfax Lane resident who adjoins the <br />back of his property. Mr. Campo said as long as the applicant recognizes that the CEI <br />easement exists and will maintain the area, he has no problem with the fence being
