ROLL CALL: <br />Chairman called the meeting to order at 5:30 p.m. <br />PRESENT: Chairman Puzzittiello, Board members; N. Althen and M. Conway <br />ALSO PRESENT: Assistant Law Director B. O'Malley, Building Commissioner D. Conway <br />and Clerk of Commissions D. Rote. <br />ABSENT: Board members R. Klesta and P. Engoglia. <br />H. REVIEW AND CORRECTION OF MINUTES: <br />The Board of Building Code Appeals minutes for May 20, 2004 are submitted for approval. <br />M. Conway motion to approve the May 20, 2004 Building Board of Appeals minutes as <br />written. N. Althen seconded the anotion which was unanimously approved. <br />III. OLD BUSINESS: <br />IV. NEW BUSINESS: <br />1. James Dunn: 4162 Laurell Lane: <br />Neighbor has an existing fence on 21 feet of rear property. A permit was issued to erect a 6 <br />foot vinyl fence to enclose entire rear yard except for 21 feet where neighbor has an existing <br />wood privacy fence already installed. This is in violation of section (1369.03 (A) 3). <br />Applicant wants to add the 21' of vinyl fence to run along side the existing section. <br />Mr. Dunn the owner came forward to address the board he would like to erect a vinyl fence and <br />21-feet of the fence overlap the neighbor's fence. His child is artistic and needs things <br />controlled and quite. The board voiced a concern over the applicant being able to maintain the <br />area between the fences. Building Commissioner reviewed that if the applicant was just <br />replacing sections of his old fence it would have been grandfathered, however the applicant is <br />replacing the entire fence and is not grandfathered. Mr. Korlea the neighbor who owns the <br />wood fence came forward to voice that he had no objections to the fence. He further indicated <br />that he would be able to maintain the area between the two fences. <br />N. Althen motioned to approve James Dunn of 4162 Laurell Lane his request to erect a <br />21-foot section of vinyl fence to run along side the existing secteon, which is in violation of <br />section (1369.03 (A 3)). M. Conway seconded the rriotion which was unanimously <br />approved. <br />Mr. O'Malley advised everyone present that although the board had a quorum with three <br />members present it takes three votes to approve any request and the applicants have a right to <br />request to be tabled until more board members are present if they wish. <br />1
