r' <br />CITY OF NORTH OLMSTED <br />CIVIL SERVICE COMMISSION MEETING <br />COUNCIL'S CONFERENCE ROOM <br />MINUTES - JULY 189 2005 <br />7:00 P.M. <br />I. ROLL CALL: Chairperson R. Giesser called the meeting to order at 7:15 p.m. <br />PRESENT: R. Giesser, M. Ubaldi, and W. Hohmann <br />ALSO PRESENT: Civil Service Secretary D. Eccleston <br />Mrs. Giesser advised that Mr. Herbster, from the Waste Water Treatment Plant, is here at this <br />meeting as a guest. Mr. Herbster is the Service Union President, AFSCME 2681, and is here to <br />represent the three employees whose job classification will be determined by the Commission. Mrs. <br />Giesser would like to address this before any other business is discussed to accommodate Mr. <br />Herbster. Also present is Ms. Farver, Director of Personnel and Administrative Services. Mrs. <br />Giesser indicated to Ms. Farver that the Charter tells the Commission to classify or un -classify all <br />positions. Mr. Herbster indicated that they are under the Collective Bargaining Unit and the Union <br />has some concerns if the three positions are reclassified to Civil Service, they may loose some rights <br />under the Collective Bargaining Agreement. A general discussion followed concerning the <br />following: all positions in a certain class should be classified the same, possible lost rights with the <br />Union if reclassified with Civil Service, Union or Civil Service prevailing over one another, any <br />changes in requirements and/or testing if the Commission changes a classification, EPA license, and <br />license versus unlicensed. Mr. Hohmann asked if the job duties are different between Class A, B <br />and C. Ms. Farver indicated that Class A, Band C have different job descriptions. Mr. Ubaldi <br />indicated that the legal description for an unskilled laborer is a job which requires no more than <br />physical fitness and sound judgment. Tasks are learned while on the job rather than a specific task <br />one has trained out side the occupation. Ms. Farver asked Mr. Herbster if a laborer C has to have a <br />CDL license and Mr. Herbster advised "yes". At an entry level position, if you are hired and do not <br />have a CDL you are considered a Laborer D and once you obtain a"CDL you are automatically a <br />Laborer C. Mr. Hohmann questioned if a group is a member of a union, should the Commission <br />make them unclassified. Ms. Farver indicated that is a legal question for Mr. Dubelko or Mr. <br />O'Malley to answer. Mr. Herbster and Ms. Farver will discuss at the next labor management <br />meeting, the different issues that have come up concerning classification. Ms. Farver asked the <br />Commission if their task would be easier if she provided a list of positions only, along with their job <br />descriptions from the Collective Bargaining Agreement. Mr. Ubaldi indicated the list would be very <br />helpful. Mr. Hohmann asked Mr. Herbster what it takes to get an EPA license. Mr. Herbster <br />advised that the EPA gives a test twice a year in Columbus. It is a combination of a Theory and <br />Math test. To pass the test, you have to have at least 75%. The other qualification would be you <br />have to work in the WWTP for 3 years in order to take the classification 1 test, 5 years in order to <br />take the classification 2 test, 6 years in order to take the classification 3 test, and be a superintendent <br />(someone who has the ability to run the plant for at least 1 year) in order to take the classification 4 <br />test. Classification 4 is a license to run a treatment plant. Mr. Ubaldi wanted to know if there are <br />any professional qualifications for an unlicensed operator. Mr. Herbster advised that they basically <br />do the same thing as a license operator but they do not have the classification license. Mr. Ubaldi <br />asked Mr. Herbster if the Operations Laborers, Greg Peters and Robert Jones, are unlicensed <br />operators. Mr. Herbster advised "yes" but Greg Peters just obtained his classification 1 license and <br />Robert Jones does not have enough time in yet. <br />
