a <br />ri <br />CITY OF NORTH OLMSTED <br />CIVIL SERVICE COMMISSION MEETING <br />MAYOR'S CONFERENCE ROOM <br />MINUTES - SEPTEMBER 19, 2005 <br />7:00 P.M. <br />I. ROLL CALL: Chairperson R. Giesser called the meeting to order at 7:00 pm <br />PRESENT: R. Giesser, M. Ubaldi, and W. Hohmann <br />ALSO PRESENT: Assistant Law Director B. O'Malley, Civil Service Secretary D. Eccleston <br />II. DISPOSITION OF MINUTES: <br />The Civil Service minutes dated July 18,. 2005 and the Special Civil Service minutes dated August <br />8, 2005 have been submitted for approval. <br />Mr. Ubaldi made a motion to accept the minutes as submitted. The motion was seconded by <br />Mr. Hohmann and unanimously approved. <br />III. COMMUNICATIONS: <br />There were 5 items of correspondence received and 4 items of correspondence sent out by the <br />Civil Service Commission. <br />Mrs. Giesser inquired if anyone had any comments on the correspondence received and sent by <br />Civil Service. Mr. Hohmann and Mr. Ubaldi advised they have no comments. <br />IV. OLD BUSINESS: <br />Determination of remaining job classification <br />Mrs. Giesser suggested the Commission first discuss the determination of the job classifications. <br />Mrs. Giesser also indicated that it would be better if Mr. Ubaldi read off the job descriptions and <br />advise the Commission if the job should be classified or un -classified. At that time, the <br />Commissioners could agree or disagree with Mr. Ubaldi's decision and when the entire list has been <br />decided, they would make a motion to approve the list. Mr. Hohmann pointed out that part of the <br />Commissioners' duty is to be consistent. Mrs. Giesser advised that there are two things impinging <br />here. The first one, Civil Service is to determine all job classifications and the second one is when <br />new positions are created, Civil Service Commission will make the determination at that point. The <br />problem is that there is a back log of positions that has not gone through Civil Service. Mr. <br />Hohmann inquired about anything they should know when determining the job classifications. Mrs. <br />Giesser and Mr. Ubaldi both indicated that the Charter sets the criteria. Mr. Hohmann brought up <br />the issue from the July, 2005 meeting when Mr. Herbster indicated concerns with the classifications <br />and did not want conflicts within the department. Mrs. Giesser advised that is why the list provided <br />by Ms. Farver has positions and no names connecting to the positions. Mr. Ubaldi advised that <br />the list had inconsistent job titles, with names attached, in the past and a red flag went up because <br />there were some employees who held the same position and were given different classifications. <br />Mr. Ubaldi asked Mr. O'Malley on a previous discussion that classification in no way nullifies a <br />Union agreement. Mr. O'Malley advised that is correct. Mr. O'Malley also indicated that the state <br />laws allows for the Collective Bargaining Agreement to override Civil Service protection. Civil <br />
