BUILDING & ZONING BOARD OF APPEALS <br />CITY OF NORTH OLMSTED <br />MINUTES FOR MEETING OF JULY 6, 2020 <br />ROLL CALL <br />Chairman Allain called the meeting to order at 7:00 pm via online public meeting. <br />Present: Eric Allain, Bob Papotto, Ralph Mackey, Suzie Patton, Dan Rahm <br />Staff. Law Director Michael Gareau, Jr., Planning Director Kim Lieber, Assistant Building <br />Commissioner Dan Russell, Administrative Assistant Nicole Rambo -Ackerman <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Papotto moved, seconded by Mr. Rahm, to approve the Building & Zoning Board of <br />Appeals minutes of June 1, 2020, motion passed 5-0. <br />RESIDENTIAL APPEALS AND REQUESTS <br />20-16778; Bill Watters; 3274 Bridgeport Drive <br />Representatives: William Watters, owner <br />Proposal consists of a deck in the rear yard. Property is zoned C -One Family Residence. <br />1. A 20 ft. variance for a rear yard setback for a deck addition; code requires 50 ft., applicant <br />shows 30 ft., Section 1135.06(D) <br />The applicant is seeking to construct an addition to the existing deck. The new deck will be at the <br />same non -conforming setback as the current structure. It will be 30 feet from the rear property <br />line, where a rear yard setback of 50 feet is required. Mr. Watters is remodeling his kitchen and a <br />door is being relocated. The deck is being extended to meet the relocated door. The easement on <br />the property will not be impacted. Ms. Lieber said the dwelling itself is setback about 50 feet <br />from the rear property line so any attached deck would require a variance. There is an existing <br />deck at the same setback. The most impacted property to the rear is a city -owned stormwater <br />management basin. <br />Scott Kutz, 23256 Sharon Drive, lives directly south of the property. He appreciates the <br />neighbor's attempt to improve his property. He is concerned about the height of the deck because <br />there is a swale. He noted it appeared construction was already underway. Mr. Watters said the <br />construction of the new deck is on hold for the variance to be approved. Mr. Kutz did not think <br />the proposal would be aesthetically pleasing and thought the request was substantial. He also <br />thought the deck would cover a lot of the property. Mr. Kutz suggested decreasing the variance <br />request or decreasing the height of the deck because all of their windows look out onto the <br />proposed deck. Mr. Allain pointed out that no height variance requested. <br />Diane Meister, 3261 Bridgeport Drive, submitted an email recommending approval of the <br />variance. <br />
