BUILDING & ZONING BOARD OF APPEALS <br />CITY OF NORTH OLMSTED <br />MINUTES FOR SEPTEMBER 13, 2021 <br />ROLL CALL <br />Chairman Allain called the meeting to order at 7:00 p.m. via online public meeting. <br />Present: Eric Allain, Bob Papotto, Ralph Mackey, Dan Rahm, Suzie Patton <br />Staff: Planning Director Kim Lieber, Law Director Michael Gareau, Building Coordinator Katie <br />Seeley, Administrative Assistant Nicole Rambo -Ackerman <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Papotto pointed out that Mr. Mackey seconded the motion to approve the July meeting <br />minutes. <br />Mr. Papotto moved, seconded by Mr. Mackey, to approve the Building & Zoning Board of <br />Appeals minutes of August 2, 2021 as corrected, motion passed 5-0. <br />RESIDENTIAL APPEALS AND REQUESTS <br />21-20046; Larry & Christina Hess; 3194 West 2301h Street <br />Representative: Larry Hess, owner <br />Proposal consists of a new patio cover. Property zoned C -One Family Residence. <br />1. A 5 ft. variance for rear yard setback of a covered patio; code requires 50 ft., applicant shows <br />approximately 45 ft., Section 1135.02(C)(4)(a). See also 1135.06(D). <br />The applicant would like to replace an existing patio cover in the rear yard. Covered patios must <br />be set back 50 feet from the rear property line, the patio cover extends five feet into the required <br />rear setback. Mr. Hess said the patio was on the house when they moved in 1988 and all <br />indications from the previous owner said the patio was on the home in 1965. They would like to <br />improve the appearance of the patio but he believed the code changed since the home was built. <br />Ms. Lieber did not object to the proposal because it is a continued use of an existing condition <br />even though there is no variance on record. <br />Mr. Papotto moved, seconded by Mr. Mackey, to approve the following variance for 21- <br />20046; Larry & Christina Hess; 3194 West 230th Street: <br />1. A 5 ft. variance for rear yard setback of a covered patio; code requires 50 ft., applicant <br />shows approximately 45 ft., Section 1135.02(C)(4)(a). See also 1135.06(D). <br />Motion passed 5-0. <br />21-20129; Kyle & Kara Wallace; 5873 Barton Road <br />Representative: Kara Wallace, owner <br />Proposal consists of garage and home additions. Property is zoned B -One Family Residence. <br />1. A 50 sq. ft. variance for area of private garage; code permits 750 sq. ft., applicant shows 800 <br />sq. ft., Section 1135.02(B)(1)(a). <br />
