CITY OF NORTH OLMSTED ORDINANCE NO. 2005 180 BY: Mayor O'Grady AN ORDINANCE PROVIDING FOR THE SUBMISSION TO THE ELECTORS OF THE CITY OFNORTH OLMSTED OFAN AMENDMENT TO ARTICLE VI, SECTION 4 OF THE CHARTER OF THE CITY OF NORTH OLMSTED AUTHORIZING THE CIVIL SERVICE COMMISSION, IN ACCORDANCE WITH OHIO SUPREME COURT DECISIONS AND TO THE EXTENT PERMITTED BY THE CHARTER, TO LAWFULLY ADOPT AND ENFORCE LOCAL RULES AND REGULATIONS THAT MAY BE DIFFERENT FROM THE STATE'S CIVIL SERVICE STATUTES, AND DECLARING AN EMERGENCY. WHEREAS, the Ohio Supreme Court has held in a number of cases that municipal civil service commissions must follow state civil service statutes unless clear and express language exists in the city's municipal charter granting authority to the municipal civil service commission to adopt local rules and regulations that are different from the State's general statutes on civil service; and WHEREAS, it is the desire of this Council to submit to the voters of North Olmsted a proposal to amend Article VI, Section 4 of the Charter of the City of North Olmsted so as to authorize the North Olmsted Civil Service Commission, in accordance with said Ohio Supreme Court decisions, to adopt and enforce local rules and regulations that may be different from the State's general statutes on civil service; and WHEREAS, this proposal was submitted by this Council to the Charter Review Commission for review and recommendation in accordance with Article XIV, Section (b)(2) of the City Charter, and, within 60 days of the date of referral, the Commission on the 2 1 day of 6 2006, filed a written report with the Clerk of Council in which th ommission stated th t, by a � to U vote, a motion to recommend approval of the proposal (passed failed); and WHEREAS, this Council has adopted this Ordinance, as required by state law, no sooner than 120 days, and no later than 60 days, prior to the date of the election at which the issue will be voted upon by the electorate; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, OHIO, TWO - THIRDS OFALL MEMBERS CONCURRING THAT:
