Ordinance No. 2005 -180 <br />SECTION I. Pursuant to Article XVIII, Sections 9 of the Ohio Constitution, and Article XII <br />of the Charter of the City of North Olmsted, this Council authorizes and directs that the following <br />proposal to amend the Charter of the City of North Olmsted be submitted to the electors of the City <br />of North Olmsted at a special election to be held at the usual places of voting in the City on Tuesday, <br />May 2, 2006: <br />That Article VI, Section 4 of the Charter be amended as follows so as to authorize the North <br />Olmsted Civil Service Commission to adopt local rules and regulations for the classified service of <br />the City that may be different from the State's general statutes on civil service: <br />ARTICLE VI THE CIVIL SERVICE COMMISSION <br />SEC. 4. PROCEDURE <br />The Civil Service Commission of the City of North Olmsted shall prescribe and enforce rules and <br />regulations for the Classified Service that may be different than State's general statutes on civil <br />service law, shall keep a record of its proceedings and examinations, which shall be open to public <br />inspection, and shall in all matters not in conflict with this Charter or the City's ordinances, <br />conduct its affairs in accordance with its own lawfully adopted rules and regulations, which may <br />be different from State's general statutes on civil service law. the provisions of the general ",w <br />and in In all promotional examinations, the Civil Service Commission of the City of North Olmsted <br />shall certify to the appointing officer after examination, the name of the top applicant to the position <br />open by promotion and the appointing officer shall appoint the said top applicant in all cases to the <br />position to be filled by promotion. <br />SECTION 2. If the foregoing proposal receives the affirmative vote of a majority of the <br />electors voting thereon, then the said amendment to Article VI, Section 4 of the Charter shall be <br />effective on July 1, 2006. <br />SECTION 3. It is the desire of the Council that the ballot for said question shall be in <br />substantially the following form: <br />PROPOSED CHARTER AMENDMENT <br />A majority affirmative vote is necessary for passage. <br />Shall Article VI, Section 4 of the Charter of the City of North <br />Olmsted be amended so as to authorize the North Olmsted Civil <br />Service Commission, in accordance with Ohio Supreme Court <br />decisions and to the extent permitted by the City Charter, to lawfully <br />adopt and enforce local rules and regulations that may be different <br />2 <br />
