Building Department accompanied by any required application forms and nonrefundable <br />application fees as per the adopted schedule of fees. All applications and development <br />plans required by this chapter shall be reviewed by the Building Official and Director of <br />Planning. <br />(b) In the event an application contains a proposal which is violative of the zoning or another <br />applicable code of the City, or the application is not accompanied by all drawings and <br />other documents or materials required by Section 1126.03 and 1126.04 or by rule of the <br />Building Official, and, if applicable, by rule of the Planning and Design Commission, it <br />shall be rejected by the Building Official, who shall notify the applicant of the reasons for <br />the rejection within seven (7) days of submittal. <br />(c) In the event an application contains a proposal which meets all requirements of the <br />zoning and all other applicable codes of the City and is accompanied by all drawings and <br />other documents and materials required by Section 1126.03 and 1126.04 and by the rules <br />of the Building Official, and, if applicable, by rule of the Planning and Design <br />Commission, it shall be referred to the Planning and Design Commission for its <br />recommendations at its next available regularly scheduled meeting. <br />(d) In the event that the application contains a proposal which requests a variance or <br />variances from the applicability of any provision of the Zoning Code of the City, but in <br />all other respects complies with the zoning and all other applicable codes of the City, and <br />is accompanied by all drawings and other documents and materials required by Section <br />1126.03 and 1126.04 and by the rules of the Building Official, and, if applicable, by rule <br />of the Planning and Design Commission, it shall be referred to the Planning and Design <br />Commission, at its next available regularly scheduled meeting, for its recommendatio-lis <br />on the variance request prior to referral to the Board of Zoning Appeals. <br />(e) The Building Official and the Director of Planning may request, in the interest of <br />expediting the review process and in anticipation of a Planning and Design Commission <br />requirement thereof, the comment or report of any appropriate City official or department <br />and shall, in the event that development proceeds under subsection (d), provide a report <br />and recommendation to the Planning and Design Commission and the Board of Zoning <br />Appeals on the variances requested. <br />1126.06 ADDITIONAL SUBMITTAL REQUIREMENTS <br />(a) The applicant shall submit along with final development plans a current and accurate <br />legal description of the property or properties in question. <br />(b) The applicant is responsible for providing a list of names, mailing addresses and parcel <br />numbers of all property owners requiring notification as defined in Chapter 149.02 of the <br />Administrative Code. <br />1126.07 REVIEW BY PLANNING COMMISSION. <br />(a) Scope of Review. All applications for building permits which are properly referred to the <br />Planning and Design Commission shall be reviewed by the Commission for the purpose <br />of making the following determinations: <br />(1) Whether the proposal is in conformance with adopted land use policies in the <br />form of plans, maps, rules and/or regulations, which have been formally adopted <br />
