CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2005 -143 <br />BY: Mayor O'Grady and Council Members Barker, Nashar, Gareau, Orlowski <br />A RESOLUTION AUTHORIZING PAYMENT AND RATIFYING <br />THE MAYOR'S EXECUTION OF A CONTRACT WITH COMM <br />STEEL INCORPORATED FOR EMERGENCY REPAIRS TO THE <br />ROOF GIRDER AT THE INDOOR POOL AREA OF THE NORTH <br />OLMSTED RECREATION CENTER, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, as the result of an outside engineering analysis and report by Leinweber <br />Engineering, LTD, it has been determined by the Mayor and the Director of Public Safety that <br />an emergency condition exists at the North Olmsted Recreation Center with respect to the <br />Roof Girder at the Indoor Pool Area, which must be repaired and corrected prior to the onset <br />of inclement weather in the Fall Season; and <br />WHEREAS, in light of the emergency situation existing, the Director of Public Safety <br />requested proposals from various qualified local contractors for the repair of the said Roof <br />Girder in accordance with plans and specifications prepared by Leinweber Engineer, LTD, <br />and, after review of the proposals received, selected the proposal of Comm Steel <br />Incorporated, because it was, in the judgment of the Director of Public Safety, the lowest and <br />best proposal; and <br />WHEREAS, the Mayor and Director of Finance reviewed and approved the proposal <br />of Comm Steel Incorporated, and the Director of Law conditionally approved the form and <br />substance of the contract to be entered into between the City and Comm Steel Incorporated for <br />said emergency repairs; and <br />WHEREAS, in light of the emergency condition existing and the need to order in <br />advance the parts necessary for the repairs, and the inability to call a special meeting of City <br />Council with sufficient members present to adopt emergency legislation during the week of <br />September 25, 2005, the Director of Public Safety submitted to the Mayor, and the Mayor, <br />given the emergency circumstances, signed the said proposed contract with Comm Steel <br />Incorporated; and <br />WHEREAS, pursuant to R.C. Section 5705.41(D), payment to Comm Steel <br />Incorporated, pursuant to said contract, may not be made by the Director of Finance until <br />authorized by this Council; and <br />
