CONTRACT FOR PURCHASE OF EQUIPMENT THIS CONTRACT is made as of the 14th day of October , 2005, by and between the CITY OF NORTH OLMSTED, 5200 Dover Center Road, North Olmsted, Ohio, hereinafter called the "CITY," and ComProducts, Inc. dba B & C Communications, hereinafter called the "Vendor." WITNESSETH: WHEREAS, pursuant to authorization of CITY Council, to -wit: Ordinance No. 2005 -124, the CITY advertised for bids for the purchase of up to Five (5) new hand -held twd way portable radios, up to Five (5) four port conditioning chargers, up to Five (5) single port conditioning units, the cost of the first year's programming for up to Five (5) units advertised for bid, the cost of a three year warranty for up to Five (5) units advertised for bid, and the annual service contract after the warranty expires for up to Five (5) units advertised for bid. Further, the Additional Specifications of Addendum I — for the purchase of up to Twenty -five (25) hand -held portable two -way radios, and up to Twenty -five (25) four port conditioning chargers, and up to Twenty -five (25) single port conditioning chargers, and the cost of the first year's programming for up to the Twenty - five (25) units advertised for bid, the cost of a three year warranty for up to the Twenty - five (25)units advertised for bid, and the cost of annual service contract after the warranty expires for the up to Twenty -five (25) units advertised for bid by the North Olmsted Fire Department, and the necessary appurtenances for each [hereinafter referred to as the "Equipment "]; and, WHEREAS, the EQUIPMENT to be supplied is to meet and conform to all of the terms, conditions, and specifications contained in the bid package, including but not limited to the instructions to bidders, bid sheet, bond specifications and insurance requirements, bid advertisement, general bid specifications, affidavits, EEOC requirements, required affidavits, and specific bid specifications (hereinafter called the "CONTRACT DOCUMENTS "); and WHEREAS, the VENDOR has submitted a bid. to provide the EQUIPMENT in accordance with the CONTRACT DOCUMENTS; and WHEREAS, the CITY Board of Control, on September 13, 2005, found and determined that the bid submitted by VENDOR was the lowest and best bid, and awarded the contract for furnishing the EQUIPMENT to VENDOR; and
