Ordinance No. 2005 -121 <br />SECTION]. Pursuant to Article XV111, Sections 9 of the Ohio Constitution, and Article XH <br />of the Charter of the City of North Olmsted, this Council authorizes and directs that the following <br />proposal to amend the Charter of the City of North Olmsted be submitted to the electors of the City <br />of North Olmsted at a special election to be held at the usual places of voting in the City on Tuesday, <br />November 8, 2005: <br />That Article III, Section 5, and Article V, Section 1, of the Charter be amended as follows to <br />clarify the existence and extent of the separate authority of the Mayor and the Directors to appoint <br />and remove various City officials and employees: <br />ARTICLE III THE MAYOR <br />SEC. 5. DUTIES AND POWERS OF THE MAYOR. <br />(a) Executive Powers. The Mayor shall be the chief executive officer of the City. He <br />shall supervise the administration of the City's affairs and shall exercise control over all <br />departments and divisions. He shall be the chief conservator of the peace within the City and <br />shall cause all laws and ordinances to be enforced. He shall be responsible for the preparation <br />and submission of the annual estimate of receipts and expenditures, and of appropriation <br />measures, and shall at all times keep the Council fully advised as to the financial condition and <br />needs of the City. He shall cause all terms and conditions imposed in favor of the City or its <br />inhabitants in any franchise or contract to which the City is a party to be faithfully kept and <br />performed. <br />.&NrBePt as ma�'Othefwise be provided by this GhaAer- or- the laws of the State of Ohio <br />-b Ci "" c°t"'" , t The Mayor shall have the power to appoint, promote, transfer, <br />reduce or remove any officer or employee of the City exeept (a), these required b this Chart , to <br />> these whose tefms of offiee may be fixed by this Chal4e that he or she is <br />expressly authorized by this Charter, or by ordinance of Council, to appoint. The <br />appointment of every officer and employee appointed by the Mayor shall, unless otherwise <br />provided in this Charter, automatically terminate at the earlier of (1) the end of the term of office <br />of the Mayor making the appointment, or (2) the date upon which the Mayor making the <br />appointment leaves office by death, resignation or other reason creating a vacancy in the office of <br />Mayor. Unless otherwise provided for in this Charter, the Mayor may during his term, without <br />concurrence of Council, remove any officer or employee whom he has appointed the authority <br />to appoint, provided, however, that heads of departments or divisions created by this Charter <br />may only be removed with the concurrence of two - thirds (2/3) of the members of Council <br />eligible to vote. <br />The Mayor shall execute on behalf of the City, all contracts, conveyances, evidences of <br />indebtedness, and all other instruments to which the City is a party. He shall have custody of the <br />seal of the City and may affix it to all of said instruments, but the absence of the seal shall not <br />affect the validity of any such instrument. The Mayor shall be recognized as the official and <br />ceremonial head of the City government by the Governor for military purposes and by the courts <br />for the purpose of serving civil processes. <br />ARTICLE V ADMINISTRATIVE OFFICERS AND DEPARTMENTS <br />SEC. 1.
