Ordinance No. 2005 -121 <br />the Council shall provide by ordinance for the organization thereof. The Council may establish by <br />ordinance new departments or divisions thereof. Except as to departments or divisions thereof <br />established by the Charter, Council may combine or abolish departments and divisions as it may <br />deem necessary and may authorize one person to be the head of two or more departments or <br />divisions. Except as- ethefwise pr-evided by this All appointments and removals in the <br />several departments shall be made by the respective directors. <br />SECTION2. If the foregoing proposal receives the affirmative vote of a majority of the <br />electors voting thereon, then the said amendments to Article III, Section 5, and Article V, Section <br />1, of the Charter shall be effective on January 1, 2006. <br />SECTION 3. It is the desire of the Council that the ballot for said question shall be in <br />substantially the following form: <br />PROPOSED CHARTER AMENDMENT <br />A majority affirmative vote is necessary for passage. <br />Shall Article III, Section 5, and Article V, Section 1, of the Charter be <br />amended to clarify the existence and extent of the separate authority <br />of the Mayor to appoint Directors and other City officials and <br />employees where such authority is expressly provided, and of <br />Directors to appoint all employees within their respective <br />Departments. <br />Yes <br />SECTION 4. The Clerk of Council is authorized and directed to deliver a certified copy of <br />this Ordinance to the Board of Elections of Cuyahoga County no sooner than July 11, 2005, and no <br />later than September 9, 2005. <br />SECTIONS. This Council requests that the Board of Elections of Cuyahoga County cause to <br />be duly given an appropriate notice of the election to be held on November 8, 2005, on the foregoing <br />amendments to the Charter of this City and otherwise provide for such election in the manner <br />provided by the general laws of the State of Ohio. <br />
