CITY OF NORTH OLMSTED ORDINANCE NO. 2005 - 115 BY: Council Members Ryan, Barker, Miller AN ORDINANCE PROVIDING FOR THE SUBMISSION TO THE ELECTORS OF THE CITY OF NORTH OLMSTED OF AMENDMENTS TO ARTICLE III, SECTION 4(D), ARTICLE IV, SECTIONS 3 AND 5, AND ARTICLE V, SECTIONS 2 AND 3, OF THE CHARTER OF THE CITY OF NORTH OLMSTED TO ALLOW FOR THE FILLING OF VACANCIES BYELECTION TO THE UNEXPIRED TERMS IN THE VARIOUS ELECTED CITY OFFICES WHEN THE VACANCY OCCURS NO LESS THAN 30 DAYS PRIOR TO THE CANDIDATE FILING DEADLINE FOR NEXT REGULAR MUNICIPAL ELECTION AND THE UNEXPIRED TERM HAS AT LEAST TWO YEARS REMAINING, AND DECLARING AN EMERGENCY. WHEREAS, as a result of an amendment to Article IX of the City of North Olmsted Charter in 2001, which established nonpartisan elections in the City of North Olmsted, the filing deadline for candidate petitions was increased from sixty (60) days to seventy -five (75) days prior to the primary election date; and WHEREAS, as a result of said 2001 Charter amendment, insufficient time now exists, pursuant to the applicable provisions of Article III, Section 4(d), Article IV, Sections 3 and 5, and Article V, Sections 2 and 3, of the Charter for a candidate to gather signatures and file a candidate petition with the Board of Election regarding a vacancy in any of the City's elected offices that occurs at or about seventy -five (75) before the filing deadline; and WHEREAS, it is the desire of this Council to submit to the voters of North Olmsted a proposal to amend Article III, Section 4(d), Article IV, Sections 3 and 5, and Article V, Sections 2 and 3, of the Charter to allow for the filling of vacancies by election to the unexpired terms in office in the various elected City offices when the vacancy occurs not less than 30 days prior to the filing deadline for municipal elections and the unexpired term has at least two years remaining; and WHEREAS, this proposal was approved by the Charter Review Commission and submitted to this Council for its consideration, in accordance with the provisions of Article XIV, Section (b)(1) of the City Charter on the 215` day of June, 2005; and WHEREAS, this Council has adopted this Ordinance, as required by state law, no sooner than 120 days, and no later than 60 days, prior to the date of the election at which the issue will be voted upon by the electorate; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, OHIO, TWO - THIRDS OF ALL MEMBERS CONCURRING THAT:
