CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2005 - 115 <br />BY: Council Members Ryan, Barker, Miller <br />AN ORDINANCE PROVIDING FOR THE SUBMISSION TO <br />THE ELECTORS OF THE CITY OF NORTH OLMSTED OF <br />AMENDMENTS TO ARTICLE III, SECTION 4(D), ARTICLE IV, <br />SECTIONS 3 AND 5, AND ARTICLE V, SECTIONS 2 AND 3, OF <br />THE CHARTER OF THE CITY OF NORTH OLMSTED TO <br />ALLOW FOR THE FILLING OF VACANCIES BYELECTION <br />TO THE UNEXPIRED TERMS IN THE VARIOUS ELECTED <br />CITY OFFICES WHEN THE VACANCY OCCURS NO LESS <br />THAN 30 DAYS PRIOR TO THE CANDIDATE FILING <br />DEADLINE FOR NEXT REGULAR MUNICIPAL ELECTION <br />AND THE UNEXPIRED TERM HAS AT LEAST TWO YEARS <br />REMAINING, AND DECLARING AN EMERGENCY. <br />WHEREAS, as a result of an amendment to Article IX of the City of North Olmsted Charter <br />in 2001, which established nonpartisan elections in the City of North Olmsted, the filing deadline <br />for candidate petitions was increased from sixty (60) days to seventy -five (75) days prior to the <br />primary election date; and <br />WHEREAS, as a result of said 2001 Charter amendment, insufficient time now exists, <br />pursuant to the applicable provisions of Article III, Section 4(d), Article IV, Sections 3 and 5, and <br />Article V, Sections 2 and 3, of the Charter for a candidate to gather signatures and file a candidate <br />petition with the Board of Election regarding a vacancy in any of the City's elected offices that <br />occurs at or about seventy -five (75) before the filing deadline; and <br />WHEREAS, it is the desire of this Council to submit to the voters of North Olmsted a <br />proposal to amend Article III, Section 4(d), Article IV, Sections 3 and 5, and Article V, Sections 2 <br />and 3, of the Charter to allow for the filling of vacancies by election to the unexpired terms in office <br />in the various elected City offices when the vacancy occurs not less than 30 days prior to the filing <br />deadline for municipal elections and the unexpired term has at least two years remaining; and <br />WHEREAS, this proposal was approved by the Charter Review Commission and submitted <br />to this Council for its consideration, in accordance with the provisions of Article XIV, Section (b)(1) <br />of the City Charter on the 215` day of June, 2005; and <br />WHEREAS, this Council has adopted this Ordinance, as required by state law, no sooner <br />than 120 days, and no later than 60 days, prior to the date of the election at which the issue will be <br />voted upon by the electorate; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, OHIO, TWO - THIRDS OF ALL MEMBERS <br />CONCURRING THAT: <br />
