Ordinance No. 2005 -115 <br />SECTION 1. Pursuant to Article XVIII, Sections 9 of the Ohio Constitution, and Article XII <br />of the Charter of the City of North Olmsted, this Council authorizes and directs that the following <br />proposal to amend the Charter of the City of North Olmsted be submitted to the electors of the City <br />of North Olmsted at a special election to be held at the usual places of voting in the City on Tuesday, <br />November 8, 2005: <br />That Article III, Section 4(d), Article IV, Sections 3 and 5, and Article V, Sections 2 and 3, <br />of the Charter be amended as follows to allow for the filling of vacancies by election to the <br />unexpired terms in office in the various elected City offices when the vacancy occurs not less than <br />30 days prior to the filing deadline for municipal elections and the unexpired term has at least two <br />years remaining: <br />ARTICLE III THE MAYOR <br />SEC. 4. VACANCY IN THE OFFICE OF MAYOR. <br />(a) Absence. When the Mayor is absent or inaccessible or is unable for any cause or <br />reason to perform his duties, the President of Council shall become the acting Mayor, but he shall <br />not thereby cease to be President of Council. <br />(b) Vacancy. In the event the office of Mayor shall become vacant for any reason, the <br />President of Council shall thereupon become the Mayor, and serve for the unexpired term or until <br />the beginning of the term of a successor duly elected as hereinafter provided, and his office as <br />President of Council shall become vacant. <br />(c) Absence of President of Council. In the event the President of Council shall be <br />absent or inaccessible or for any reason unable to perform his duties as acting Mayor, then <br />Council, by a vote of a majority, shall designate one of their number to act as Mayor. <br />(d) Election of Successor in the Event of Vacancy_ In the event the office of Mayor <br />shall become vacant, a successor for the unexpired term shall be elected as Mayor at the next <br />regular municipal election, provided that (a) such election shall occur more than two (2) years <br />prior to the expiration of the unexpired term and (b) the vacancy shall have occurred not less <br />than thirty (30) days prior to the candidate filing deadline for said next regular municipal <br />election. A President of Council or a councilman, who has become Mayor pursuant to <br />subsections (b) and (c) of this Section, may be a candidate to succeed himself. <br />ARTICLE IV THE COUNCIL <br />SEC. 3. PRESIDENT OF COUNCIL. <br />(a) Separate Office. The President of Council shall be elected by the voters. <br />Candidates for such office shall file specifically for the office in accordance with the provisions <br />of the Charter. <br />(b) Duties. The President of Council shall preside at all regular and special meetings <br />of Council, but he shall have no vote therein except in the event of a tie. He shall perform such <br />duties as presiding officer as may be imposed upon him by Council. <br />(c) Acting Mayor. In the absence of the Mayor, the President of Council shall act as <br />Mayor as provided in Article III of this Charter. <br />(d) Vacancy in Office. Whenever the office of President of Council becomes vacant, <br />the vacancy shall be filled by appointment by majority vote of the members of Council eligible to <br />
