CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2005 —106 <br />BY: Mayor O'Grady <br />AN ORDINANCE AMENDING SECTION ONE OF ORDINANCE <br />NO. 2004 -104, WHICH PRE VIOUSLYAMENDED ORDINANCE NO. <br />2004 -18, IN ORDER TO REMOVE THE MAXIMUM DOLLAR CAP <br />IN THE CONTRACT THAT AUTHORIZED THE RETENTION OF <br />THE LAW FIRM OF JOHNSON, ANGELO & COLALUCA, LLC, AS <br />OUTSIDE LABOR COUNSEL TO ASSIST THE CITY IN LABOR <br />RELATED MATTERS, AND <br />APPROVING ALL PAYMENTS <br />FIRM. <br />FURTHER RATIFYING AND <br />MADE TO DATE TO SAID LAW <br />WHEREAS, this Council, on February 12, 2004, adopted Ordinance No. 2004 -18, <br />which authorized retention of the law firm of Johnson, Angelo & Colaluca, LLC, as labor <br />negotiators and outside counsel to assist the City in then current labor negotiations, and <br />further authorized a maximum expenditure of Thirty Thousand Dollars to said law firm <br />for the rendering of such legal services; and <br />WHEREAS, this Council, on June 1, 2004, adopted Ordinance No. 2004 -104, <br />which amended Ordinance No. 2004 -18 to provide for the expenditure of additional <br />funds for additional labor- related legal services to be rendered by Johnson, Angelo & <br />Colaluca, LLC, up to a maximum of an additional Thirty Thousand Dollars, and further <br />authorized the Mayor, subject to approval of the Board of Control, to enter into an <br />amended Agreement with Johnson, Angelo & Colaluca, LLC; and <br />WHEREAS, in the ensuing one year period, from June 2004 to June 2005, the <br />firm of Johnson, Angelo & Colaluca, LLC, now known as Johnson & Colaluca, LLC, <br />continued to represent the City in the labor matters for which it was retained and <br />continued to submit invoices to the City, on a monthly basis, for fees associated with the <br />services rendered; and <br />WHEREAS, this Council, on March 22, 2005, adopted Ordinance No. 2005 -17, <br />the annual appropriations ordinance, which reflected a budget prepared by the <br />Administration providing for an additional Thirty - Thousand Dollars ($30,000.00) to be <br />paid for outside labor counsel fees; and <br />WHEREAS, this Council, on June 21, 2005, this Council adopted Ordinance No. <br />2005 -94, a Transfer Appropriations Ordinance, which, amongst other things, provided for <br />an additional Forty Thousand Dollars ($40,000.00) to be appropriated for outside labor <br />counsel fees; and <br />
