lvk <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2005 -105 <br />By: Mayor O'Grady <br />AN ORDINANCE AMENDING ORDINANCE NO. 2005 -55 IN <br />ORDER TO PROVIDE FOR THE PROPERTY MAINTENANCE <br />INSPECTOR POSITION CREATED BY SAID ORDINANCE TO <br />BE A PART -TIME, RATHER THAN SEASONAL, POSITION IN <br />THE ORGANIZATIONAL CHART OF THE BUILDING <br />DEPARTMENT, AND DECLARING AN EMERGENCY. <br />WHEREAS, in order to increase and improve real property maintenance code inspections <br />in the City, this Council, on April 19, 2005, adopted Ordinance No. 2005 -55, which, inter alia, <br />created a new seasonal property maintenance code inspector position in the Building Department; <br />and <br />WHEREAS, as a result of subsequent discussions with representatives of AFSCME Local <br />2681, Clerical & Technical Unit, in May of 2005, regarding inclusion of certain part-time clerical <br />and technical positions in said bargaining unit, it is recommendation of the Administration that the <br />new position be changed from a seasonal position, which, under SERB law, that may not be <br />employed for more than fourteen (14) weeks in a year, to "part- time," which has no such restriction <br />under SERB law and which will therefore enable the City to employ the individual holding the said <br />inspector position for more than fourteen (14) weeks in a year; and <br />WHEREAS, in order to assure that the new property maintenance inspector is available to <br />the City for code enforcement for at least seven months (or approximately twenty -eight (28) weeks) <br />per year, as noted in Ordinance No. 2005 -55, it is the desire of this Council, accordingly, to amend <br />said Ordinance No. 2005 -55, in order to provide for the new inspector position to be part-time rather <br />than seasonal; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That Section 1 of Ordinance No. 2005 -55, which presently reads as follows: <br />"A. The Organizational Chart for the Building Division and the personnel set forth in the <br />Organizational Chart shall consist of the Building Commissioner, who shall be in charge of the entire <br />Building Division, and the other officials and employees set forth in paragraphs B and C. <br />B. The Building Commissioner shall also be in charge of the Inspection Personnel, which <br />shall consist of: one (1) Assistant Building Commissioner, four (4) full -time Building Inspectors, <br />
