C l <br />ICES MOBILE - MAINTENANCE SERVICES <br />Compuhensive Business Solutions, Inc. shall provide Maintenance Services related to as <br />may be necessary and reasonable to cause ICES Mobile to conform to and perform in all <br />material respects in accordance with the applicable Software Specifications. For as long <br />as CBS, Inc. is obligated to maintain and support the ICES Mobile Software under this <br />Agreement, CBS, Inc. shall respond to customer's request for assistance within eight (8) <br />working hours (Monday through Friday, 8:30 a.m. to 5:00 p.m. EST, holidays excluded) <br />after such request is made. Additionally, CBS, Inc. shall use its best effort to cause the <br />ICES Mobile Software to operate substantially in accordance with its specifications. <br />The Maintenance fee will be invoiced separately, each expiring on the respective <br />anniversary date. (See Attachment A) <br />HARDWARE WARRANTY <br />Compuhensive Business Solutions, Inc. has chosen Compaq as the manufacturer and <br />supplier of the Portable Digital Assistants (PDA's). CBS, Inc. will serve as the channel <br />from customer to the manufacturer. We are not directly or indirectly responsible for <br />damaged or malfunctioning equipment, the manufacturer is ultimately responsible for <br />their product during the warranty period. Compuhensive Business Solutions will, as a <br />part of the Maintenance Agreement, pick the damaged hardware up from the customer <br />site and contact Compaq for assistance / resolution. In the event the equipment requires <br />to be sent to the manufacturer, CBS will pay all shipping and handling costs associated <br />with the return of equipment. Customer will be billed for all actual costs to repair the <br />hardware. Receipts will be provided as support of the invoiced amount. Maintenance <br />Services relating to hardware will only be available while manufacturer warranty is in <br />place. <br />Compaq provides a one -year mail -in warranty on their PDA devices. Compaq offers an <br />extended three -year warranty that can be purchased directly from the manufacturer by the <br />customer. It is NOT the responsibility of CBS, Inc. to apply for the product warranty or <br />track warranty expiration. We will provide to the customer with the Compaq warranty <br />cards date of purchase and serial number. Customer will be responsible in completing <br />the warranty card and submit to manufacturer. <br />Annual Maintenance Fee — ICES / ICES MOBILE <br />Price calculated as follows: <br />ICES Software (Existing Maintenance Agreement) <br />$1,339.00 <br />ICES Mobile Solution 7 units <br />$1,049.00 <br />Total Amended Annual-Maintenance <br />$2,388.00 <br />"Prices Subject to Change" <br />
