CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2005 - 62 <br />BY: Council Member Gareau <br />AN ORDINANCE AMENDING SECTION 915.04 (USER CHARGES) <br />OF THE STREETS, UTILITIES AND PUBLIC SERVICES CODE, IN <br />ORDER TO CHANGE THE PROCEDURE FOR OBTAINING A <br />REFUND IN THE SEWER CHARGE REFUND PROGRAM FOR <br />USERS OF LESS THAN ONE THOUSAND CUBIC FEET (MCF) OF <br />WATER PER BILLING QUARTER, AND FURTHER TO <br />ESTABLISH NEW QUALIFICATIONS FOR ENTITLEMENT TO <br />PARTICIPATE IN THE SAID PROGRAM, AND DECLARING AN <br />EMERGENCY, AS AMENDED . <br />WHEREAS, this Council, on August 6, 2002, adopted Ordinance No. 2002 -76, which <br />established a sanitary sewer charge refund program for North Olmsted property owners who use <br />less than one thousand cubic feet (mcf) of water per billing quarter; and <br />WHEREAS, the City has learned, over the past two years that the said program, as <br />originally established, is time consuming and expensive for the Finance Department to <br />administer, and the Director of Finance has accordingly recommended that the program be <br />reformed by requiring participants to directly apply for refunds and by further requiring in the <br />future that only property owners who qualify for homestead exemption may participate in the <br />program; and <br />WHEREAS, it is the desire of this Council to act in a fiscally responsible manner in <br />attempting to preserve current sewer rates in the Sewer Fund for all property owners; and <br />WHEREAS, it is further the desire of this Council to amend Section 915.04 (User <br />Charges) of the Streets, Utilities and Public Services Code in order to reform the Sewer Charge <br />Refund Program and provide new standards, in the future, for eligibility to participate in the <br />program; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMS TED, COUNTY OF CUYAHO GA, AND STATE OF OHIO: <br />SECTION 1: That Section 915.04 (User Charges) of Chapter 915 of the Codified <br />Ordinances, which presently reads as follows: <br />"915.04 USER CHARGES. <br />(a) All premises within the corporation limits of the City shall pay a sewer user charge <br />based upon the quantity of water used on the premises as shown by the records of the Division of <br />Water of the City of Cleveland, unless specified otherwise in this chapter. <br />
