CITY OF NORTH OLMSTED ORDINANCE NO. 2005 — 39 BY: Mayor O'Grady AN ORDINANCE AMENDING ORDINANCE NO. 2004 -138, ENTITLED "PRELIMINARY LEGISLATION, " IN ORDER TO REVISE THE PROJECT DESCRIPTION FOR AN IMPROVEMENT TO GREAT NORTHERN BOULEVARD (SR -252) WITHIN THE CITY OF NORTH OLMSTED, AND DECLARING AN EMERGENCY. WHEREAS, on October 5, 2004, the City enacted Ordinance No. 2004 -138, entitled, "Preliminary Legislation," a copy of which is attached as Exhibit A, for the Project Description, Consent Statement and other preliminary commitment necessary to enable the City to participate in a roadway improvement project for Great Northern Boulevard (SR -252) in conjunction with the State of Ohio, and by and through the Ohio Department of Transportation (ODOT); and WHEREAS, ODOT has proposed to amend the Project Description and has specifically requested that the City appropriately amend Ordinance No. 2004 -138, which provided the City's preliminary consent for the Project, in order to reflect the amended scope of the Project; and WHEREAS, it is the desire of this Council, upon the recommendation of the Director of Public Service, to amend Ordinance No. 2004 -138 accordingly in order to amend the Project Description for said project as proposed by ODOT; NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That Section I of Ordinance No. 2004 -138, entitled "Project Description," which presently reads as follows: "Whereas, the STATE has identified the need for the described project: Improve the riding quality of Great Northern Boulevard (SR -252) from Butternut Ridge Road to Country Club Boulevard a distance of 0.36 mile more or less in the City of North Olmsted. This work is part of a larger ODOT project that involves the resurfacing of Columbia Road in the City of North Olmsted, the City of Olmsted Falls and Olmsted Township." Be amended, and, as amended, shall read as follows: "Whereas, the STATE has identified the need for the described project: I
