'. i� Id's CITY OF NORTH OLMSTED ORDINANCE NO. 2005- 27 BY: Council Members Miller, McKay, Nashar and Kasler AN ORDINANCE PROVIDING FOR THE SUBMISSION TO THE ELECTORS OF THE CITY OF NOR THOLMSTED OFAN AMENDMENT TO SECTIONS 1, 2 AND 3 OF ARTICLE IT , AND SECTIONS 2 AND 4 OFARTICLE IX, OF THE CHARTER OF THE CITY OF NOR TH OLMSTED TO PRO VIDE FOR THE PRESIDENT OF COUNCIL TO BE A MEMBER OF COUNCIL APPOINTED BY A MAJORITY OF THE MEMBERS OF COUNCIL, RATHER THAN A SEPARATELY ELECTED OFFICE, AND DECLARING AN EMERGENCY, AS TWICE AMENDED. WHEREAS, it is the desire of this Council to submit to the voters of North Olmsted a proposal to amend Sections 1, 2 and 3 of Article IV, and Sections 2 and 4 of Article IX, of the Charter so as to provide for the President of Council to be a member of Council appointed by a majority of the members of Council, rather than a separately elected office; and WHEREAS, this proposal was submitted by this Council to the Charter Review Commission for review and recommendation in accordance with Article XIV, Section (b)(2) of the City Charter, and, within 60 days of the date of referral, the Commission on the 17th day of May, 2005, filed a written report with the Clerk of Council in which the Commission stated that, by a 3 -2 vote, a motion to recommend approval of the proposal failed; and WHEREAS, this Council has adopted this Ordinance, as required by state law, no sooner than 120 days, and no later than 60 days, prior to the date of the election at which the issue will be voted upon by the electorate; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, OHIO, TWO - THIRDS OFALL MEMBERS CONCURRING THAT:
