Ordinance No. 2005 -27 <br />SECTION]. Pursuant to Article XVIII, Sections 9 of the Ohio Constitution, and Article XII <br />of the Charter of the City of North Olmsted, this Council authorizes and directs that the following <br />proposal to amend the Charter of the City of North Olmsted be submitted to the electors of the City <br />of North Olmsted at a special election to be held at the usual places of voting in the City on Tuesday, <br />November 8, 2005: <br />That Sections 1, 2 and 3 of Article N, and Sections 2 and 4 of Article IX, of the Charter be <br />amended to provide for the President of Council to be appointed by a majority vote of the members <br />of Council, as follows:: <br />"ARTICLE IV <br />THE COUNCIL <br />SEC. 1. NUMBER AND TERMS. <br />All legislative powers of this City, except as otherwise provided by this Charter and by <br />the Constitution of the State of Ohio, shall be vested in a Council of seven (7) members, four (4) <br />of whom shall be elected by the several wards and three (3) of whom shall be elected at large. <br />Commencing with the regular municipal election in the year 1977 and every fourth year <br />thereafter, the President of Counei four (4) members of Council elected from the several <br />wards shall be elected for a term of four (4) years. Said members of Council so elected and the <br />President of Gauneil shall assume office on the first day of January next following their election. <br />Commencing with the regular municipal election in the year 1979 and every fourth year <br />thereafter, the three (3) members of Council elected at large shall be elected for a term of four (4) <br />years. Said members of Council so elected shall assume office on the first day of January next <br />following their election. <br />SEC. 2. QUALIFICATIONS. <br />No person shall be eligible to be a member of Council unless he shall have been a <br />resident for at least two years immediately prior to the date of his election and during his term of <br />office shall continue to be a resident of the City of North Olmsted and a qualified elector thereof. <br />In addition, no person shall be eligible to serve as a ward Councilman unless he shall have been a <br />resident of the ward from which he is elected at least one year immediately prior to the date of his <br />election. <br />Except as otherwise provided in this Charter, no member of Council shall hold any other <br />municipal office or employment by the City of North Olmsted. A member of Council shall not <br />directly or indirectly solicit, contract for, receive, or be interested in any profit or emolument <br />from or on account of any contract, job, work, or service with or for the City. <br />Any member of Council who ceases to possess any such qualification, or moves from his <br />ward, if elected from a ward, or from the City, if elected from the City at large, shall forfeit his <br />office. <br />2 <br />
