CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2005 —16 <br />BY: Mayor and Entire Council. <br />AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO <br />AN ACQUISITION AGREEMENT WITH THE GREATER <br />CLEVELAND REGIONAL TRANSIT AUTHORITY, PROVIDING <br />FOR THE SALE OF ASSETS AND TRANSFER OF ALL NORTH <br />OLMSTED MUNICIPAL BUS LINE OPERATIONS TO THE <br />GREATER CLEVELAND REGIONAL TRANSIT AUTHORITY, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the Greater Cleveland Regional Transit Authority ( "Authority ") was <br />established in 1975 for the purpose of providing transportation throughout Cuyahoga <br />County; and <br />WHEREAS, the City of North Olmsted ( "City") has owned and operated the <br />North Olmsted Municipal Bus Line ( "NOMBL ") within a service area of western <br />Cuyahoga County since 1931; and <br />WHEREAS, the City and the Authority have entered into a succession of five - <br />year Public Transportation Operating Agreements since 1975; and <br />WHEREAS, the most recent such agreement expired on December 31, 2004, but <br />was mutually extended by the parties for an additional 90 -day period until March 31, <br />2005, for the purpose of providing the parties with additional time to determine whether <br />they should execute a new Operating Agreement or instead an Acquisition Agreement; <br />and <br />WHEREAS, the Mayor and Council have sponsored this acquisition legislation <br />because RTA has, to the date of preparation of this legislation, refused to agree to a <br />renewal of the parties' Public Transportation Operating Agreement, unless the City agrees <br />to subsidize NOMBL operations annually with approximately $1.8 million from the <br />City's general fund; and <br />WHEREAS, given this refusal by the Authority to fairly negotiate and propose a <br />renewal on reasonable terms, the Mayor and Council are compelled to sponsor this <br />legislative action authorizing the acquisition and transfer of NOMBL to the Authority in <br />order to protect the quality and the level of bus transit service in the North Olmsted <br />community and surrounding areas, and further to provide job security for the 65 NOMBL <br />employees who have been told by the Authority that they will only be offered jobs with <br />RTA if North Olmsted agrees to transfer its NOMBL bus line to RTA; and <br />
