Ordinance No. 2005 -16 <br />WHEREAS, while it would clearly be the preference of this Council to have a <br />real choice in the matter, that is, to either approve a renewal or extension of the Operating <br />Agreement for a sufficient period of time to enable an outside study to be conducted to <br />determine whether the interests of mass transit in Cuyahoga County would best be served <br />by elimination NOMBL and the Maple Heights Bus Line, or to authorize a transfer of <br />NOMBL operations to RTA pursuant to an agreement that was freely and fairly <br />negotiated, it is ultimately the duty and obligation of this Council, when called upon to <br />take legislative action, to act in a responsible manner that best serves the interests of the <br />North Olmsted community, including the NOMBL ridership and the 65 employees of <br />NOMBL; and <br />WHEREAS, it is accordingly the intent of Council, given the foregoing <br />circumstances, to fully authorize the Mayor to enter into an Acquisition Agreement with <br />the Authority; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized to execute an <br />acquisition agreement between the City of North Olmsted and the Greater Cleveland <br />Regional Transit Authority, selling assets and transferring all operations of the North <br />Olmsted Municipal Bus Line to the Greater Cleveland Regional Transit Authority. The <br />agreement shall be in a form and substance, negotiated by the Director of Law and <br />approved by the Mayor, that protects the current levels of transit service in the North <br />Olmsted service area; that further protects the job security of all employees of the North <br />Olmsted Municipal Bus Line; and that finally provides full and fair compensation to the <br />City of North Olmsted regarding certain grievances that were raised by the City and <br />addressed by the Authority at the negotiation table. <br />SECTION 2: That the Mayor is further hereby authorized to execute, deliver and <br />perform all such further agreements, instruments, documents and acts in the name of and <br />on behalf of the City as shall be required to carry out the intent and purposes of this <br />Ordinance. <br />SECTION 3: That this Ordinance supersedes all other Ordinances and/or <br />Resolutions previously adopted by this Council relative to the Public Transportation <br />Operating Agreements between the City of North Olmsted and the Greater Cleveland <br />Regional Transit Authority, and any such Ordinance or portion thereof which is <br />inconsistent with any of the provisions of this Ordinance is hereby repealed. <br />2 <br />
