a 4 <br />WHER.EAS, pursuant to a reorganization of the CITY's Division of Engineering, <br />authorized by CITY Council pursuant to Ordinance No. 2007-156, it is now necessary for <br />the CITY to obtain addifiional engineering services over and above those obtained in its <br />original contract, as extended from time to tirne, with CITY ENGINEER and <br />CONSULTING ENGINEER; and <br />WHEREAS, the CITY Council, pursuant to Ordinance No. 2007-157, and in <br />recognition of tlie reorganization of the Division of Engineering as authorized by <br />Ordinance No. 2007-156, has authorized the Mayor of the CITY to enter into and execute <br />a new contract with the CONSLTLTING ENGINEER, CITY ENGINEER and the <br />ASSISTANT CITY ENGINEER, extending and aulendin.g the previous contract with the <br />CONSULTING ENGINEER and CITY ENGINEER; and <br />NOW THEREFORE, the CITY, CTTY ENGINEER, ASSISTANT CITY . <br />ENGINEER, and CONSULTING ENGINEER, each acknowledging the su£ficiency of <br />the consideration contained in tbe tenns and conditions of the Agreement, agree as <br />follows: <br />SECTION 1. BASIC SERVICES. <br />1.1 The SERVICES required to be performed by the CITY ENGINEER, and <br />ASSISTANT CTTY ENGINEER under this Agreement shall be the basic services <br />provided to the CITY. <br />1.2 For providing the basic services, the CITY ENGINEER sha11 receive a <br />retaining fee in the sum of Thirty Six Thousand Dollars ($36,000.00) per annum. The <br />ASSISTANT CITY ENGINEER shall receive a retaining fee in the szun of Eighteen <br />Thousazid Dollars ($18,000.00) per annum. The retaiuing fees shall be paid on a <br />biweekly basis comi.neucing upon the effective date of this Agreement, aiid the ainounts <br />sha1l be subject to the contxibution by the CITY and the CITY ENGINEER aild <br />ASSISTANT CITY ENGINEER, respectively, to PERS. In consideration of said <br />retaining fees, CITY ENGINEER and ASSISTANT CITY ENGXNEER shall pzovide a11 <br />of the following basic services: <br />(a) Give infonnation and advice, as iieeded and as directed audJor authorized <br />by the Director of Public Service, to Cauncil, the Mayor, Directors and <br />2
