BEDFORD HEIGHTS CTTY JAIL <br />CONTRACTING E-NTITY <br />CONTRACTUAL AGREEMENT <br />This agreement made aiid entered into tl-ie day of , 2007, <br />by aiid between t11e City of North Olmsted, (hereafter called Contracting Entity) and the City of <br />Bedfoi-d Heights, Ohio (hereafter called Bedford Heights); <br />WITNESSETH; <br />WIIERAS, the Coiatracting Eiitity has inadequate facilities for confining and supporting all <br />prisoners, which the Contracting Entity is required by law to coilfine aiid support by reason of <br />seiitence imposed upoil them as a result of eonvictions or guilty pleas to charges of violations of <br />any ordinance or statutes of the law, awaitiilg hearing for such violation, or awaiting trial of any <br />such violation; aiid <br />WHERAS, Bedford Heights Qwns and operates a full service and nlinimum security jail <br />aiid presently has other contractual arrangements for the coi-ifineinent and support of prisoners <br />including a Joint Agreement for Construction, Operation and Maintenance of Miniinum SecLUity <br />Jail executed with Village of Moreland Hills, the Village of Glenwillow and the Village of Chagrin <br />Falls in April, 1993. <br />NOW, THEREFORE, it is mutually agreed between the parties: <br />The Contracting Entity may send to Bedford Heights and Bedford Heights agrees to <br />accept from the Contracting Entity such prisoner(s) as Contracting Entity is unable <br />to caxe for and provide custody, supervzsion, confinement, and board for the <br />Contracting Entity prisoner(s) based upon availability of space. The Contractirig <br />Entity shall furnish transportation for prisoner(s) to Bedford Heights City Jail. <br />2. Effective January l, 2008, the Contracting Entity agrees to pay Bedford Heights tlae <br />sum of Eighty Dollars ($80.00) per day as fizll compensation for supervising, <br />coilfiniilg and boarding each prisoner, and effective July l, 2008, the sum shall <br />increase to Eighty-five Dollaxs ($85.00) per day, <br />For the purpose of deternlining compensation to be paid, any caleildar day or part <br />thereof of confinemeiit sllall constitute one day. <br />4. There shall be an additional charge of Thirty-Five Dollars ($35.00) for each use of <br />the video anaigzlment equipinent and/or BAC Verifier. <br />The Coi7tractiiig Entity furtlier agrees to pay a physician for any ziledical costs <br />incui7•ed by said prisonez•(s) of the Coiltractiilg Entity. <br />6. The Contracting Entity further agrees to pay or reimburse Bedford Heights for any <br />eapenses ii7ci-irred ii1 rendering or sacuring other medical, surgical, dental or mental <br />1lealth services, including nledicines and suz-gical operations, for or to such <br />prisoner(s). <br />
