The medical staff of the Bedford Heights City Jail shall clel:ermine the <br />need for sLicli services. <br />Bedlord Heights may reject or refuse i:o receive any prisoner wlio may be inflictE;d <br />wii:h a prior medical problern such as a contagious disease, mental condition, illness <br />or inj ury that has not been rirst treated prior to entry into the Iledford Heights City <br />Jail. The Beclford Heights Chief of Police shall have charge ofthe jail and be, or his <br />designee, may, in the exercise of his or izer discretion, refuse to receive aily prisoner <br />for any reason based upon current jail population, internal security conditions of 1he <br />j ail, or any other reasons including availability of space. <br />9. This Agreement is based upoil daily availability of space in the Bedford Heights <br />jail. The parties recognize that Bedford Heights has commitmellts with other <br />Participating and Cooperating Conuilunities that will affect availability of space and <br />may be reason to remove prisoner(s) of tlle Contracting Entity from tlze Bedford <br />Heights j ail and return the custody, supervision, confinement aizd board of tllem to <br />the Contracting Entity. Specifically, the Joint Agreement referred to above with the <br />Participating Communities of the Village of Moreland Hills, the Village of <br />Glenwillow and the Village of Chagrin Falls pursuant to which the City of North <br />Olmsted, will be considered as a Contracting Entity states as follows: <br />"3.03 The City of Bedford Heights may permit Cooperating Communities to <br />use the Facility on an as-available daily basis. In the eveilt tlie Facility is full <br />at the time a Participatuig Commuziity has need for the use of the Facility <br />for the ntunber beds specified in Section 3.02*, the City of Bedford Heights <br />shall make a good faith attempt to relocate prisoiZers of a Cooperating <br />Comnlunity or else advise the Cooperating Coinmui7ity to ren-iove their <br />prisoiler in order to provide room for the prisoner of a Participating <br />Conununity.
