? <br />? <br />8 <br />Upon the filing of a complaint, the State or local agency shall initiate an <br />investigacion to obtain information concerning the alleged discriminatory <br />housing practice. The factual data must be developed, and the <br />respondent's policies and practices rnust be documented. Respondents' <br />rebuttal statements of the allegations do not constitute an investigation and <br />are not to be viewed as such. <br />2. In planning the investigation, the investi`lator and housing supervisor must <br />determine on a case-by-case basis whether the investigation should be <br />conducted on or off-site. <br />(a) Off-site investigations may be considered where: <br />• Complaints do not involve factual disputes; <br />• Evidence as submitted shows Lt clear cause case; or <br />• Evidence as submitted shows a clear no-cause case. <br />(b) In most other situations involving investigations of complaints, an on- <br />site visit is the most thorough way to conduct an investigation. <br />Beginning with the filing of a complaint. the agency shall attempt <br />conciliation. <br />4. At the end of each investigation, the agency shall prepare a Final <br />Investigative Report (FIR). The FIR shall contain: <br />(a) The names and dates of contacts with witnesses, except that the <br />report will not disclose the names of witnesses who request <br />anonymity; <br />(b.) A summary and the dates of con-espondence and other contacts <br />with the aggrieved person(s) and the respondent(s); <br />(c) A summary description identifying other pertinent records <br />examined; <br />(d) A summary of statements by wilnesses, if applicable; andlor <br />(e) Inten-ogatories and answers provided, if applicable. <br />A FIR may be amended at any time, if additional evidence is discovered. <br />6. For the purpose of FHAP funding support, an investigation is completed <br />when at least one supervisor has signed the investigative report. <br />7.
