The GTR will make monthly status requests <br />of each case that is over 100 days old. <br />When the agency completes the processing oF a dual-filed complaint, all <br />documentation as required in section 8 of the cooperative agreement and <br />section A.3 of the Statement of Work shall be forwarded to the appropriate <br />HUD GTR within 30 days. The agency will provide the closure data required <br />within 30 days of the administrative hearing order or court decision if the <br />complaint is not closed at the time payment is approved. If the agency does <br />not provide this closure information, the G'TR may request that up to 50°Io of <br />the per case reimbursement previously paid he retul-ned. <br />9. For Investigation and Conciliation of Complaints filed by Organizations, see <br />Attachment B. <br />II. REASONABLE CAUSE OR NO REASONABLE C'AUSE DETERMINATION <br />A. Rec?uirements for Acceptance <br />TI1e rationale behind a reasonable or no reasonable cause finding is that the <br />investigation has shown sufficient or insufficierit evidence to support allegations <br />raised. Such evidence is generally established by determining whether (1) the <br />da[a, information, and analysis are sufficient to conclude that the incident that <br />occui-red serves as the basis of the allegations made by the complainant and/ar <br />information disclosed in the course of the investi jation; (2) the unit sought was <br />actually available and on the market at the time of the alleged occurrence; and (3) <br />race, color, religion, sex, handicap, familial status, or national origin was a factor <br />in the decision to deny or• otherwise alter the te.i-ms and conditions or privileges of <br />the sale, Lenta] or financing of housing sought by the complainant. These <br />examples are not intended to be exhaustive. <br />B. Documentation Required: The case file must be submitted to the GTR using the <br />case file format provided by HLTD. The GTR wi II review the case file, and at a <br />minimum the case file must include (note: the GTR may waive the requirement <br />to have the following documentation submitted in hard copy format if <br />TEAPOTS is fully and appropriately used): <br />The Final Investigative Report; <br />The Evidentiaiy Section; <br />A log/control sheet; and <br />4. Working papers. <br />
