11 <br />i'easible, will attempt to conciliate the complaint. In conciliating a complaint, agencies <br />will attemPt to achieve a just resolution of the complaint and obtain assurances that the <br />respondent will satisfactorily remedy any violations of the rights o{'the aggrieved person <br />and tal<e such action as will assure the elimination of discriminatory housing practices or <br />the prevenlion of their occunences in the future. <br />A. Successful Conciliation <br />Requirements for Acceptance. The conciliation agreement must: <br />a. be in writina with clearly defined terms and conditions. It must be signed <br />by the complainant, respondent, and the State or local agency <br />representative authorized to enter into suc:h agreements; <br />b. include terms which remedy the unlawfu'; discrimination identified in the <br />complaint and provide r-elief or compensiition for the complainant; <br />c. contain provisions to adequately vindicate the public interest, and prohibit <br />recun-ing future discriminatory housing ??ractices by the respondent; <br />d. specifically state that the agreement constitutes closure of the complaint <br />filed with HUD and the State or local agency; <br />e. contain a provision stating that the agreement shall be made public unless <br />the complainant and respondent otherwise agree, and the authorized <br />representative of the agency determines that disclosure is not required to <br />further the purposes of the State or local agency; <br />* These standards for conciliation remain in effect even if conciliation talces place after the <br />agency's reasonable cause determination. <br />Examples of circumstances that rnay result in partial disclosure or <br />nondisclosure of a conciliation wTreement, include but are not <br />limited to: <br />• Conciliation talces place af'te1• the agency's reasonable cause <br />deteimination; <br />• Sexual harassment alle?ations that may be embarrassing or <br />humiliating to the parties: <br />• Disc7imination based on Li physica] or mental disability that <br />the complainant may not want disclosed; or <br />• Complainant is a resideni in a home for battered women <br />who may be concel-ned about her safety if the agreement <br />
