The concilialion agreement does not prohibit HUD <br />from taking further action against the respondent under applicable <br />i•ules and regulations of the other civil rights authorities. When the <br />abency has been notified that a complaint is subject to concurrent <br />processing, the agency will not execute an agreement on the Fair <br />Housing Act violations unless HUD concurs with the terms and <br />conditions. . <br />Unsuccessful Conciliation <br />Requirements for Acceptance. Attempted conciliation efforts were <br />unsuccessful and the State or local agency made a reasonable cause <br />determination. <br />b. Documentation Required. Al] conciliation efforts should be well <br />documented in the Final Investig?ition Report. Documentation <br />showing failed conciliation efforts must include: <br />(i) a copy of the material required in Section I.E. (3)-(8) above <br />regarding Final Investigative Reports; <br />(ii) a copy of the reasonable cause determination notices to the <br />complainant, the respondent, or tlie aggrieved person on whose <br />behalf the complaint is filed (such notice shall inform these <br />persons of the procedures requii-ed for election and describe the <br />remedies available under each); <br />(iii) a copy of the response to the notices described in (b) above (if <br />there is no response, documentation should be included in the case <br />file); and <br />(iv) a copy of the con-espondence or other documentation that <br />i-eports on the failed conciliation attempt(s) including pertinent <br />dates. <br />Cases Set for Administrative Proceedings, Civil Action, or Judicial <br />Review
