13 <br />a. Where the agency's conciliation effons are not successful, the <br />complaint must be set for administrative or civrl action, under the State <br />or local law. HLTD shall accept the case for funding supporl when the <br />agency provides documentation that indicates the date of referral for <br />such legal action. <br />b. The agency will report the final decision of any administrative <br />hearing or civil proceecling to the appropriate field office. If the <br />abency does not pi-ovide this inform<<<ion within 30 days of the fina] <br />decision, the GTR, with the concui7-ence of the Cooperative <br />Agreement Officer (CAO) may reca??eui-e up to 50% of the payment. <br />IV. CLOSURE BI' SETTLEMENT <br />If the complainant and respondent agree to settle the complaint without the State or local <br />agency's involvement, the complainant may wish to withdraw the complaint. If the ; <br />complaint is resolved as a result of the complainant's withdrawal, the GTR must review <br />the terms and conditions of the settlement to determine whether the following criteria are <br />satisfied. <br />A. Withdrawals with Resolution. A withdrawal wich resolution is based only on the <br />complainant's request for withdrawal of a complaint because the complainant and <br />respondent have agreed upon a resolution. <br />1. Requirements for Acceptance. The withdrawal request must: <br />a. be in writing; <br />b. be signed by the complainant, oi- authorized representative, and dated; <br />c. identify the respondent to whom the withdrawal applies; <br />d. contain the HiTD case number and the State or local agency case <br />number; <br />e. explain the reason(s) complainant wishes to withdraw the complaint <br />(see also VI.3 of this Criteria); <br />f. eontain a statement that there was nc> coercion or fear of retaliation <br />from any peiā¢son (not just the respondent); and <br />g, inform the complainant(s) and respondent(s) that the complainant may <br />re-file the complaint if the terms of the settlement are not satisfied <br />where the discriminatory housing prLictice has not exceeded the <br />statutoi-y limitation of the State or local faii- housing law. <br />? 4;
