AG.REEMENT WITH RECYCLER <br />FOR RECYCLING <br />NEWSPAPERS, MIXED PAPER AND CARDBOARD <br />FROM MEMBERS OF THE CUYAHOGA COUiNTY <br />PAPER I`IA12IiETYNG COOPERATIVE <br />THIS AGItEEMENT (Ao eement)`is entered into by and between the Cuyahoga CoLinty Solid <br />Waste Mana;ement District, hereinafter referred to as the "District", and Che Caraustar Industries Inc. <br />Recovered Fiber Plant, located at 3400 Vega Avenue in Cleveland, Ohio, hereinafter referred to as the <br />"Recycler" aild Ilereinafter collectively refe.rred to as the "Parties". <br />RECITALS <br />tiVHEREAS, the Cuyahoga County Solid Waste District has, pursuant to Sections 3734.54 and <br />3734.55 of the Ohio Revised Code, prepared, adopted, and received approval from the Director of the <br />Ohio Environmental Protection Agency for a solid waste mana?ement plan.(the Plan), to providz <br />adequate solid waste recycling and disposal capacity and soLind solid waste mana-ement alternatives to <br />households and businesses within the geographic boundaries of the District; and <br />tiVHEREAS, one of the strategies adopted pur.suant to the Plan is to help develop markets for <br />recyclables collected by political subdivisions, businesses, instittitions and other waste generators witlzin <br />the District; and <br />WHEREAS, pursuant to Section 343 of the Ohio Revised Code, the authority of the District <br />ailows it to contract with political subdivisions to market their collected recyclables; and <br />WHEREAS, the District has advertised for and received proposals from local recycling <br />companies to receive, process and recycle paper eollected by various political subdivisions who wil-l be <br />entering into lntergovernmental Agreements (in the form attached hereto as Ezhibit A) to participate in <br />tile Cuyahoga County Paper Marketing Cooperative; and <br />WHEREAS, a list of the political subdivi5ions who have signed Letters of Interest to participate <br />in tlle Cuyaho;a Coiuity P<iper Marketiiia Cooperative_'(hereinafter the "Cooperative Mer?ibers") is <br />attached as Exhibit B; and <br />WI-IEItEAS, the District and the Cooperative Members have selec;ted the Rzcycler based upon the <br />Recycler's Proposal, Nvhich is lttached as Exhibit C and incorporated as if tully reNN1'it[en herein, and tlle <br />District lias determiried to enter into this Acreement pursuant to tlie Recycler's Proposll and the selection <br />by the Cooperative Memvers; and <br />bV[-IFIZEAS, the Recycler has the necessas-y personnel, experience and expertise to receive, <br />proccss atid recycle paper collected by the C'ooperative Members. <br />NOW TI-ICRrPORE, in consideration of the mutuzl promises and obliaatioils contained herein, <br />the District and the Recyclcr agree by and between themselves as follows: <br />
