The Recycler shall accept from all Cooperative Members, unlimited quantities of Newspaper that <br />meet the speeifications for #8 News as defined in the Recycler's Proposal attached as Exhibit C. <br />B. The Recycler shall accept from all CooperatCve Members, unlimited quantities of lvlixed Paper <br />tliat meet the specifications for Grade #1 Mi:ced Paper as defined in the Recycler's Proposal <br />attached as Ethibit C. :. <br />C. The Recycler shall accept from al] Coaperative Members, unlimited quantities of Cardboard that <br />meet the specifications for #11 OCC as defined iil the Recycler's Proposal attaclled as Eshibit C. <br />D. The terrn "Outthrows" as used throu?hout this section cs defined as all papers that are so <br />manufactured or treated or are in such a form as to be tinsuitable for consumption as the grade <br />specified. <br />E. The term "Prohibited Materials" as used throuC.71101.1t this section is defined as anv materiais Nvhich <br />by their presence in a packinJ of paper stock, in excess of the amount-alloN?•ed, «-ill make the <br />packagina unusable as the grade specified, or any materials that may be damagina to equipment. <br />F. Any Cooperative Ivlember that collects and/or delivers paper loads that do not meet the grade <br />specifications as defined in the Recyclers Proposal or exceed the allowable percenta;e for <br />Outthrows and Prohibited Materials will assist the Recyc(er's personnel in c(eanino the (oad to <br />acceptable levels and dispose of the rejected material. The Recycler resen,es the right to charge <br />any such Cooperative member $50.00 per ton for the disposa.l of any rejected material not ? <br />renioved by such Cooperative Member. <br />Articlc III: Recvclina <br />The Recycler shall recycle or arrange for the recycling of all Newspapers, Mixed Paper and/or Cardboard <br />whicll is accepted pursuant to this Acyreement. The term "recycle" for purposes of this Agreement shall <br />have the same meaning as the term "Recyclin;" which is defined in Chapter 3745 of the Ohio Revised <br />Code and/or the regulations promulgated thereunder or as may be amended or replaced from time to time <br />by the Ohio Legislature or the Ohio EPA. •. <br />A{-ticie IV: Beneficial Relationshin <br />A. The Recycler acknowledges that the District has entered into Intergovernmental Agreements xvith <br />polilical subdivisions to Uecome members of the Cuyahoga County Paper Niarketina Cooperative <br />in the form attached as Exliibit A, the terms and conditions of «•hich the Recycier accepts and <br />acl<nowledbes. Thc Recycler fiirtller acknowledges that this Agreement is also for the benefit of <br />thc Caoperative Mcnibers, and that such Cooperative 1vlPmbers are third-party beneficiaries of <br />this Acrcement. <br />13. 1'he District slialf have no liability to the Recycler for an,y breach ofthis Anreement and the <br />ltecycler, which is a third-party beneficiary of the Intergovernmental Aarezment shall look solely <br />to thc appropriate C'ooperative Member in the event of breach b}• such Cooperative Member. <br />C.
