' . <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2007 - 103 <br />BY: Council Members Gareau, Jones and Barker <br />AN ORDINANCE AMENDING SECTIONS 1115.06 AND 1139.01 <br />1145.03 OF THE NORTH OLMSTED ZONING CODE IN ORDER TO <br />LIMIT THE LOCATION OF CORRECTIONAL FACILITIES TO THE <br />CITY'S LIMITED INDUSTRY- <br />IND USTRIAL PARK DISTRICT, AS AMENDED. <br />WHEREAS, this Council, upon review, finds that the State of Ohio permits <br />severai types of community located correctional facilities including: 1) alternative <br />residential facilities (defined in 2929.01(A)(1)); 2) community based correctional <br />facilities (see 2301.51 through 2301.58); 3) half-way houses (defined in 2929.01(P)); and <br />4) community correctional facilities (for juvenile offenders, see 5139.36) and that all of <br />such facilities may house persons with felony convictions or with histories of violent <br />crimes; and <br />If"HEREAS, this Council, upon review, finds that community based correctional <br />facilities may pose a substantial rislc to the safety of residents as well as substantial <br />bLu-den on community resources; and <br />TVHEREAS, it is accordingly the desire of this Council to ameud Sections <br />1115.06 and 1139.01 of tlie Zoning Code in order to limit the location of con-ectional <br />facilities as described above to the City's g°ra' r°*Et;' b,.s;n°ss limited industry- <br />industrial park district; and <br />WHEREAS, the Planning & Desigil Commission on the 12th day of September, <br />2007, vy f01"111a1 T110t1021, (Fc?eozniiiendvd dra--n6ti-cc0mmv°iid) -(vPrch-?suggefrted C-ha-??6j <br />recommended t11at i-+is-Ordiiiance 2007-103 in its oriOnal form providing for <br />correctional facilities to be permitted in the general retail business district be <br />adopted; and <br />WHEREAS, this Council, cognizant of the comments made at the Planning <br />and Desism Commission meeting of September 12, 2007, as reflected in the minutes <br />of the Planning and Desi2n Commission, re2ardin2 the feasibility of locating <br />coi•rectional facilities in the City's limited industry-industrial park district, rather <br />than in the general retail business district, specifically finds that there are in fact a <br />suff'icient number of prouerties alon2 Lorain Road, west of the CEI right of wav <br />easemeut that are currently zoned for limited industry-industrial park district use, <br />and Nvhich wouid be feasible far the location of a correctionll facility; and <br />WHEIZEAS, following piiblication of newspaper notice in conformance with the <br />pi-ovisions of Section 14 of Article IV of the Charter of the City of North Olmsted and <br />Section 1127.03 of the Nort11 QI nsted Zoning Code, a public hearing was held on this <br />proposed legislation on fl1e day of 2007; <br />i
