??. <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2007 - 27 <br />BY: Mayor O'Grady and Council Member Jones <br />AN ORDINANCE AMENDING SECTION 521.11 OF THE GENERAL <br />OFFENSES CODE IN ORDER TO ESTABLISH NEW <br />REGULATIONS RELATING TO THE DEPOSIT OF SNOW AND ICE <br />ON PUBLIC SIDEWALKS, TREE LAWN AREAS, AND DRIVEWAY <br />APRONS IN THE CITY OF NORTH OLMSTED, AND DECLARING <br />AN EMERGENCY, AS AMENDED. <br />WHEREAS, this Council received complaints last winter of public sidewalks in <br />commercial districts of the City being rendered impassable by commercial property <br />owners depositing snow plowed from parking lot areas onto public sidewalks; and <br />WHEREAS, this Council accordingly desires to create new regulations regarding <br />the depositing of snow and ice upon public sidewalks, tree lawn areas and driveway <br />aprons, in order to protect the safety of pedestrians during the winter season; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION l: That Section 521.11 of the General Offenses Code, which <br />presently reads as follows: <br />521.11 DEPOSIT OF SNOW, ICE AND SLUSH. <br />(a) No person, owner, tenant or person in charge of real estate acting either <br />individually or through an agent, employee or subcontractor, shall deposit snow, ice or <br />slush upon the property of another without permission. In no event shall such snow, <br />ice or slush be deposited upon City streets. <br />SHALL BE AMENDED, AND, AS AMENDED, SHALL READ AS FOLLOWS: <br />521.11 DEPOSIT OF SNOW, ICE AND SLUSH. <br />(a) No person, owner, tenant or person in charge of real estate acting either <br />individually or through an agent, employee or subcontractor, shall deposit snow, ice or <br />slush upon the property of another without permission. For purposes of this section, <br />"property of another" shall include tree lawn areas and driveway aprons that abut real <br />property owned by any other person, partnership, corporation or other legal entity, and <br />sliall also include any public street and any public sidewalk. <br />(b) The prohibitions of this section shall not apply to srreet snow and/or ice <br />clearing operations conducted by the City of North Olmsted. <br />??....q... .1 ? d.. ,<?,:? ?.?.... ,_ ? .,.
