?h CITY OF NORTH OLMSTED RESOLUTION NO. 2007 - 4 BY: Council Member Gareau A RESOLUTION AUTHORIZING THE CITY TO CONDITIONALLY DONATE A GRAVE LOT AT BUTTERNUT RIDGE CEMETERY OR COE CEMETERY TO KACIREK FUNERAL HOME, INC. FOR THE PURPOSE OF INTERRING THE CREMATED REMAINS OF FORTY (40) PERSONS UNCLAIMED BY THEIR NEXT OF 1CIN, AND WAIVING FEES AND CERTAIN OTHER RESTRICTIONS OF CHAPTER 943 OF THE STREETS, UTILITIES AND PUBLIC SERVICES CODE. WHEREAS, over the course of its many years of service to residents of the City of North Olmsted, Kacirek Funeral Home has accumulated the cremated remains of forty (40) people that have not been claimed by next of kin; and WHEREAS, this Council believes that the City has a moral and societal obligation to provide assistance in disposing of these unclaimed remains in a dignified and respectable manner; and WHEREAS, Kacirek Funeral Home has offered to provide at its cost a burial vault to inter the said remains if the City would donate a grave lot at a City cemetery, and pay or waive all remaining fees and costs associated with such interment; and WHEREAS, this Council desires to conditionally authorize the donation of a grave lot to Kacirek Funeral Home, to pay all costs of interment of the said cremated remains other than the cost of the burial vault, and to waive fees and certain restrictions within Chapter 943 of the Streets, Utilities and Public Services Code; NOW, THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO. SECTION 1: That the Mayor and the Clerk of Council are hereby authorized, on behalf of the City of North Olmsted, to donate and convey to Kacirek Funeral Home, Inc., a single grave lot at either Butternut Ridge or Coe Cemetery for the purpose of interring therein the cremated remains of forry (40) persons whose next of kin have failed to claim the cremated remains from Kacirek Funeral Home, Inc. It is a condition of this donation that Kacirek Funeral Home, Inc. shall execute a document, agreeing to provide a burial vault at its sole expense and further agreeing to defend, indemnify and hold the City harmless against any and all claims, and from any and all liability and/or damages, that may in any manner whatsoever may arise out of the interment of the said unclaimed cremated remains at either of the City's two cemeteries. Said document shall be in substantially the form of the document entitled "Acceptance of Conditional Donation of Grave Lot," marked as "Exhibit A," and attached to this Resolution,
