<br />(2) Bylaws of the Homeowners Association including: <br />A. Meetings; <br />B. Board of Managers; <br />C. Off'icers and their duties; <br />D. Assessments and finances; and <br />E. Rules and regulations. <br />(Ord. 90-125. Passed 5-21-91.) <br />1136.13 REPORT TO COUNCIL. <br />Within sixty days after a cluster site plan has been filed with the Building <br />Official, the Planning Commission shall evaluate the plan and reports required above <br />and it shall furnish to Council its detailed report and recommendations with respect <br />thereto. The report of the Commission shall include a fmding either that the site plan <br />complies with the regulations, standards, and criteria prescribed by this Zoning Code <br />for single family cluster development applicable to the proposal, or a finding of any <br />failure of such compliance and a recommendation that the site plan be approved, <br />disapproved or modified. If in any such evaluation, the Commission fmds that any <br />regulations, standards or criteria prescribed by this Zoning Code are inapplicable <br />because of unusual conditions of the development area, or the nature and quality of the <br />proposed design, it may recommend to Council that an adjustment in such regulations, <br />standards or criteria be made, provided, however, such adjustment will not be in <br />conflict with the promotion of the public health, safety and general welfare of the City. <br />(Ord. 90-125. Passed 5-21-91.) <br />1136.14 ACTION BY COUNCIL. <br />Following receipt of the Planning Commission report, and its own review, <br />Council shall either approve, disapprove or modify the site plan. Council may affirm <br />any report of the Commission by a majority vote of its members. If Council reverses a <br />report of the Commission recommending disapproval of the cluster site plan, it shall <br />only do so by the aff'irmative vote of not less than two-thirds of its members. <br />Following approval of the cluster site plan, Council shall proceed with the <br />amendment of the Zoning Map as provided in Chapter 1127 by classifying the <br />development area as a SFC Single Family Cluster zoning district. <br />(Ord. 90-125. Passed 5-21-91.) <br />1136.15 BUILDING PERMITS. <br />Following the rezoning of the cluster development area to SFC, approval of <br />the cluster area site plan by Planning Commission, Council, the City Engineer and Fire <br />Chief and approval of building plans by the Building Department, building and other <br />permits may be issued upon payment of the required fees. <br />(Ord. 90-125. Passed 5-21-91.) <br />1136.16 PHASED DEVELOPMENT. <br />A developer, having obtained final approval of a cluster site plan, may <br />accomplish the development in progressive stages as may be approved by the Planning <br />Commission and City Engineer. <br />(Ord. 90-125. Passed 5-21-91.) <br />1136.17 AMENDMENT TO PLANS. <br />(a) At any time after the approval of a cluster site plan of a development <br />area, the owner or owners may request an amendment of their plans. The request for <br />such amendment shall be filed with the Planning Coxnmission and one copy filed with <br />the Clerk of Council. If such amendment is in substantial agreement with the approved <br />cluster area site plan, it shall be processed by the Planning Commission. <br />
