<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2007- 74 <br />BY: Mayor O'Grady <br />AN ORDINANCE CONSENTING TO AND VACATING A PORTION <br />OF KENNEDY RIDGE ROAD AND APPROVING THE VACATION <br />PLAT PRESENTED BY THE GREATER CLEVELAND REGIONAL <br />TRANSIT A UTHORITY ("GCRTA "), AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the Greater Cleveland Regional Transit Authority ("GCRTA") has <br />acquired property on the north side of Kennedy Ridge Road, at the west end, and has been <br />engaged in the planning and development with the City of North Olmsted to expand its <br />Park N Ride facilities, subject to Council's adoption of the favorable recommendation of <br />the Planning and Design Commission, and conditioned upon securing the access of <br />utilities, the termination of said roadway, and vacation of a portion thereof; and <br />WHEREAS, the GCRTA, the City Engineer and the County Engineer have <br />outlined the procedure to request both the County Commissioners and the City of North <br />Olmsted to consent and approve a Vacation Plat for a portion of Kennedy Ridge Road, in <br />recognition that said portion is no longer necessary for public use, resulting in <br />conveyance of ownership to the GCRTA; and <br />WHEREAS, the Planning and Design Commission on May 9, 2007 recommended <br />approval of a Plat to Vacate a portion of Kennedy Ridge Road, in conjunction with and as <br />a condition of its favorable recommendation of a development plan proposal by GCRTA <br />for expansion of the Park-N-Ride, as said Vacation Plat is attached hereto as Exhibit A; <br />and <br />WHEREAS, by separate legislation, GCRTA proposes to enter into a Kennedy <br />Ridge Maintenance and Repair Cost Agreement with the City to, amongst other things, <br />provide funding for the cost of maintenance and repair of Kennedy Ridge Road, including <br />the "hammerhead" terminus proposed thereon; and <br />WHEREAS, by separate legislation, GCRTA offers an Access Easement to the <br />City to secure, amongst other things, the obligations and use of the "hammerhead" <br />terminus proposed for Kennedy Ridge Road; and <br />WHEREAS, by separate legislation, GCRTA offers a Water Main Easement to <br />the City to provide utilities service in the vicinity of Kennedy Ridge Road, especially the <br />area to be vacated; and <br />
