. _ ?., <br />Ordinance No. 2007-74 <br />WHEREAS, subject to approval of the Park N Ride development plan, <br />performance of the aforesaid conditions, including the County Commissioner's <br />concurrence, this Council finds, pursuant to Ohio Revised Code Section 723.05, good <br />cause to vacate a portion of Kennedy Ridge Road as no longer necessary as a public road, <br />and further consents to the County's vacation of said county road within this <br />municipality, and authorizes acceptance of the Vacation Plat attached as Exhibit A; and <br />WHEREAS, the City authorizes and directs the City Engineer, by and through <br />title and escrow agents, to file and record the Vacation Plat only in conjunction with <br />GCRTA's presentation of executed Easement documents and performance of said <br />Agreement, so that the Vacation can be immediately followed by said Easements; and <br />WHEREAS, based upon the recommendations of the Director of Public Service <br />and the City Engineer, upon the advice and assistance of the Director of Law, it is the <br />desire of this Council to consent to and otherwise vacate a portion of Kennedy Ridge <br />Road, subject to and conditioned upon securing said Easements and Agreement, and <br />thereafter to authorize, accept and consent to filing the Vacation Plat offered by the RTA; <br />NO W, THEREFORE, BE IT ORDAINED B Y THE CO UNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That a portion of Kennedy Ridge Road, as is more fully described <br />and depicted on the Vacation Plat attached as Exhibit A, be and the same is subject to <br />vacation by the Cuyahoga County Commissioners, with the consent, concurrence and as <br />herein vacated by the City of North Olmsted, subject however to the satisfaction of <br />conditions outlined herein: <br />1. That the Greater Cleveland Regional Transit Authority ("GCRTA") perform <br />in accordance with the Kennedy Ridge Maintenance and Repair Cost <br />Agreement; <br />2. That GCRTA provide Access and Water Line Easements to the City, to be <br />escrowed by the City Engineer and/or title company of his selection, to be <br />filed and recorded with Cuyahoga County immediately following recording of <br />the said Vacation Plat. <br />SECTION 2: That the Director of Public Service, together with the City <br />Engineer, upon GCRTA's performance of the conditions outlined in Section 1, as <br />determined by the said City officials, are hereby authorized to transmit the said Vacation <br />Plat, by and through title agency if deemed necessary, in cooperation with the County <br />Engineer and upon the necessary approvals of the Cuyahoga County Commissioners, to <br />be filed and recorded with appropriate Cuyahoga County offices, and thereafter to cause <br />the aforesaid Access and Water Line Easements to be filed. <br />2 <br />
