0 <br />-?? <br />?--A-- <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2007 - 95 <br />BY: Council Member Ryan <br />AN ORDINANCE AMENDING SECTION 525.16 OF THE GENERAL <br />OFFENSES CODE SO AS TO PROVIDE CRIMINAL PENALTIES <br />FOR STORES THAT ALLOW SHOPPING CARTS TO BE REMOVED <br />FROM THEIR FACILITY OR PROPERTY. <br />WHEREAS, this Council finds that shopping carts that are removed from store <br />owners' properties and abandoned in the right-of-way, on public sidewalks, or on other <br />public or private properties without permission, constitute a nuisance; and <br />WHEREAS, it is accordingly the desire of this Council to amend Section 525.16 <br />of the General Offenses Code, which currently only authorizes the impoundment of such <br />abandoned shopping carts, so as to in addition provide criminal penalties against stores <br />that allow shopping carts to be removed from their properties and left on the properties of <br />others, including public property; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Section 525.16 of the General Offenses Code, which <br />presently reads as follows: <br />"525.16 IMPOUNDING SHOPPING CARTS. <br />(a) Any police officer may remove and/or impound any shopping cart which <br />is unattended and has been abandoned on public grounds, and/or on the right of way of <br />public sidewalks and public streets. <br />(b) Any person desiring to redeem an impounded shopping cart must present <br />to the Police Division proof of right to possession and pay storage charges at the rate of <br />fifty cents (50¢) per day with a minimum storage charge of fifteen dollars ($15.00). The <br />City shall dispose of the shopping cart after a thirty-day period, as provided by law." <br />BE AMENDED, AND, AS AMENDED, SHALL READ AS FOLLOWS: <br />"525.16 PROHIBITIONS AND IMPOUNDING OF SHOPPING CARTS. <br />(a) No person or organization that owns and/or operates a retail store in <br />y of North Olmsted shall allow customers or others to remove shonuing cart <br />retail onerations from the nronertv uaon which such retail operations are <br />nducted and abandon or otherwise leave such c <br />blic nropertv or the private propertv of others. <br />,,;. <br />. -ffa.0,,,.."
