'?` ....:.. ? . .'.?...- ...v,. <br />? <br />Ordinance No. 2007-99 <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CDUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the formal RFP process required by Sections 111.03 et seq. of the <br />Administrative Code is hereby dispensed with by reason of the continuing professional <br />relationship between the City, the Cuyahoga County Public Library, and R.C.U. Architects, <br />Inc., and the Mayor be and he hereby is authorized to enter into an agreement with R.C.U. <br />Architects, Inc. to provide architectural design services, including design development and <br />preparation of constrLiction documents, for the North Olmsted Branch Library Improvement <br />Project, which will include the design for a pick-up window addition. <br />SECTION 2: That said agreement shall be in a final form and substance consistent <br />with the Agreement attached to this Ordinance as "Exhibit A," and with the Architectural <br />Services Proposal of R.C.U. Architects, Inc., dated August 16, 2007, and, in such final form <br />and substance, not slibstantially adverse to the Ciry. The character of any such changes to the <br />attachments as not being substantially adverse to the City shall be evidenced conclusively by <br />the execution of the agreement by the Mayor and the approval of the agreement by the <br />Director of Law. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare and for the <br />Curtlier reason that the agreement must go into effect immediately so as to avoid the potential <br />financial penalties associated with arbitrage. <br />PASSED: First .Reacling: dle;/ O <br />Seeon.cl Reacling: <br />Third Reading: <br />Committee: <br />A TTEST: <br />? <br />/ <br />f3ARBA1L4 L.
