TElVIPORARY RIGHT OF WAY AGREEMENT <br />PARCEL NO. 95T <br />AUDITOR'S PERMA.NENT PARCEL NO. 233-24-036 <br />The Construction of Crocker Road (CR-11$) and the <br />Grading, Draining, Paving and Widening of Stearns Road (CR-76) <br />In the Cities of Westlake and North Olmsted, County of Cuyahoga, State of Ohio <br />ARTICLES OF AGREEMENT <br />KNOW ALL MEN BY THESE PRESENTS THAT: <br />The City of Norlh Olinsted, a municipal corporation, the Grantor herein, for and in <br />consideration of the sum of ONE DOLLAR-($1:00) paid to it by the County of Cuyahoga, ui the <br />name, and for the use of the Board of County Commissioners of Cuyahoga County, the Grantee, <br />the receipt of which is hereby acknowledged, does hereby grant, bargain, sell, convey and release <br />to said Grantee, its successors and assigns forever, a temparary easernent described as Parcel No. <br />95T, and more fully described in Exhibit "A" attached hereto and incorporated herein by <br />reference; and does hereby authorize the said Grantee, or its duly authorized agents or <br />contractors to enter upoil and use said teznporary easement area during the construction of the <br />above highway improveinent for the purpose of performing the work necessary for construction <br />of the herein described project in accordance with plans and specification prepared by the Office <br />of the Cuyahoga County Engineer for the Construction/Improvement of Crocker-Stearns Road in <br />the Cities of Westlake and North Olmsted <br />Grantor claims title by instrument(s) recorded in Volume 10340, Page 153, of Cuyahoga <br />County Records. <br />To have and to hold said temporary easement, for the aforesaid purposes and for the <br />anticipated period of time described, unto the Grantee, it successors and assigns forever. <br />The duration of the teinporary easement herein granted to the Grantee is twenty-four months <br />immediately following the date on which the work described is first commenced by the Grantee,
