.- <br />? . : .,?,:.. ..., ., <br />Resolution No. 2004-202 <br />of Section 163.59 of the Ohio Revised Code relating to negotiations by public agencies for the <br />purpose of purchasing private property for public purposes. <br />SECTION 2: That the Director of Law, or the Mayor, as applicable under the City <br />Charter, are further hereby authorized and directed to execute, deliver and perform all such <br />further agreements, instruments, documents and acts in the name of and on behalf of the City of <br />North Olmsted as shall be required to carry out the intent and purposes of this Resolution. <br />SECTION 3: That all resolutions or ordinances, or parts of resolutions or ordinances, <br />that are inconsistent or in conflict with this Resolution are, to the extent of any such <br />inconsistency or conflict, hereby repealed. <br />SECTION 4: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare of the <br />community, and for the further reason that it is necessary that this Resolution go into effect <br />immediately in order to keep the land acquisition process within the project schedule and to <br />preserve the funding source voted for by the electorate; and further provided it receives the <br />affirmative vote of two-thirds of all members of Council, it shall take effect and be in force <br />immediately upon its passage and approval by the Mayor. <br />PASSED: <br />ATTEST.• <br />FirstReading: 14 I3( /Uq <br />Second Reading: 0 C? <br />Third Reading.• <br />Committee: <br />, ?.zu <br />BARBARA L.
