<br />(40) "Grade (established street)" means the elevation established by the <br />Municipality at the roadway, centerline or curb in front of the lot. <br />(41) "Grade (finished)" means the elevation of the finished surface of the <br />ground adjoining the building after final grading and normal settlement. <br />(42) "Grade (natural)" means the elevation of the undisturbed natural surface <br />of the ground prior to an excavation or fill. <br />(43) "Greenhouse (commercial)" means a structure containing 400 square feet <br />or more of floor area used primarily for the raising of products for sale either on a <br />wholesale or retail basis whether on or off the lot. <br />(44) "Greenhouse (private)" means a structure containing less than 400 square <br />feet of floor area, in which no produce, plants or flowers are raised for sale or sold <br />whether on or off the lot. <br />(45) "Home occupation" means a gainful occupation enumerated in this Code <br />conducted by members of a resident family wholly within a dwelling. <br />(46) "Homeowners' association" means an incorporated, nonprofit <br />organization operating under recorded land agreements through which each lot <br />owner of a development area is a member and under which each lot is subject to <br />charges for a proportionate share of the expenses for the organization's activities <br />such as maintaining the common property. The function of a homeowners' <br />association is the maintenance of dwelling units, common areas and other <br />facilities and the provision of services to residents. <br />(47) "Home professional office" means an office in a dwelling occupied by a <br />person practicing a profession enumerated in this Code. <br />(48) "Hospital" means a building in which is maintained facilities for medical <br />or surgical care of bed patients for a continuous period longer than twenty-four <br />hours, which is open to the general public twenty-four hours each day and has <br />separate facilities for emergency care. <br />(49) "Improvements" means permanent additions to real property that are <br />designed to make the property more useful or to increase its value, such as <br />buildings, parking and utilities. <br />(50) "Kennel" means a building or structure used to board and care for dogs, <br />cats and other four-footed domestic animals. <br />(51) "Land use" means the various ways in which land may be employed or <br />occupied. <br />(52) "Law Director" means the chief legal officer for the City. <br />(53) "Loading space" means an open or enclosed space, other than a street, <br />used for temporary parking of a commercial vehicle while its goods are being <br />loaded or off loaded. <br />(54) "Mechanical amusement device" means a machine, device or instrument <br />that upon the insertion of a coin, plate, disc, plug, key or token of value, or <br />payment of money operates or may be operated for use as a game, contest of skill <br />or amusement of any description. Music devices (juke boxes), postage dispensing <br />machines, kiddie ride machines and other penny-operated machines are not <br />included in this definition. Use of a building or any part of a building for a <br />mechanical amusement device shall be accessory only to a permitted main use. <br />(55) "Municipality" means the City of North Olmsted. <br />(56) "Occupancy certificate" or "certificate of occupancy" means an official <br />statement certifying that a building, other structure or parcel of land is in <br />compliance with the provisions of all applicable codes, or is a lawfully existing <br />nonconforming building or use and hence may be occupied and used lawfully for <br />the purposes designated thereon. <br />(57) "Occupancy (mixed)" means the occupancy of a building or land for <br />more than one use. <br />4 <br />
