(40) "Grade (established street)" means the elevation established by the Municipality at the roadway, centerline or curb in front of the lot. (41) "Grade (finished)" means the elevation of the finished surface of the ground adjoining the building after final grading and normal settlement. (42) "Grade (natural)" means the elevation of the undisturbed natural surface of the ground prior to an excavation or fill. (43) "Greenhouse (commercial)" means a structure containing 400 square feet or more of floor area used primarily for the raising of products for sale either on a wholesale or retail basis whether on or off the lot. (44) "Greenhouse (private)" means a structure containing less than 400 square feet of floor area, in which no produce, plants or flowers are raised for sale or sold whether on or off the lot. (45) "Home occupation" means a gainful occupation enumerated in this Code conducted by members of a resident family wholly within a dwelling. (46) "Homeowners' association" means an incorporated, nonprofit organization operating under recorded land agreements through which each lot owner of a development area is a member and under which each lot is subject to charges for a proportionate share of the expenses for the organization's activities such as maintaining the common property. The function of a homeowners' association is the maintenance of dwelling units, common areas and other facilities and the provision of services to residents. (47) "Home professional office" means an office in a dwelling occupied by a person practicing a profession enumerated in this Code. (48) "Hospital" means a building in which is maintained facilities for medical or surgical care of bed patients for a continuous period longer than twenty-four hours, which is open to the general public twenty-four hours each day and has separate facilities for emergency care. (49) "Improvements" means permanent additions to real property that are designed to make the property more useful or to increase its value, such as buildings, parking and utilities. (50) "Kennel" means a building or structure used to board and care for dogs, cats and other four-footed domestic animals. (51) "Land use" means the various ways in which land may be employed or occupied. (52) "Law Director" means the chief legal officer for the City. (53) "Loading space" means an open or enclosed space, other than a street, used for temporary parking of a commercial vehicle while its goods are being loaded or off loaded. (54) "Mechanical amusement device" means a machine, device or instrument that upon the insertion of a coin, plate, disc, plug, key or token of value, or payment of money operates or may be operated for use as a game, contest of skill or amusement of any description. Music devices (juke boxes), postage dispensing machines, kiddie ride machines and other penny-operated machines are not included in this definition. Use of a building or any part of a building for a mechanical amusement device shall be accessory only to a permitted main use. (55) "Municipality" means the City of North Olmsted. (56) "Occupancy certificate" or "certificate of occupancy" means an official statement certifying that a building, other structure or parcel of land is in compliance with the provisions of all applicable codes, or is a lawfully existing nonconforming building or use and hence may be occupied and used lawfully for the purposes designated thereon. (57) "Occupancy (mixed)" means the occupancy of a building or land for more than one use. 4
