nonconforming building or use and hence may be occupied and used lawfully for the purposes designated thereon. (56) "Occupancy (mixed)" means the occupancy of a building or land for more than one use. (57) "Off-street parking" means an open or enclosed area, other than a street, used for the parking of motor vehicles accessory to a main building or use. (58) "Open space" means land that is either undeveloped or is improved with various recreation facilities. (59) "Performance bond" means a bond posted by a developer, contractor or subcontractor that contains the guarantee of a surety that a specific project will be completed and meet any standards or specifications that have been agreed upon. (60) "Performance standards" means criteria that are set to ensure that a particular structure, operational activity, type of land use or development will be able to meet certain minimum standards so that its impact upon the community will not exceed established limits. (61) "Person" means a person or persons, firm or corporation. (62) "Public utility" means any person, firm, corporation, governmental agency or board fully authorized to furnish and furnishing under governmental regulation, to the public, electricity, gas, steam, telephone, telegraph, transportation or water, or any other similar public utilities. (63) "Recreation (active)" means recreational activities that require physical participation. Sports (such as baseball, tennis and gol fl are typical of active recreation. (64) "Recreation (passive)" means pleasurable activities that involve relative inactivity, such as sitting, strolling, card playing and picnics. (65) "Regulation" means a rule, restriction or other mandatory provision in this Code intended to control, require or prohibit an act. (66) "Restaurant - Full Service" means a business establishment whose princiual business is the selling of unpackaged food to the customer in a readv-to-consume state, in individual servings, or in non-disuosable containers, and where the customer consumes these foods while seated at tables or counters located within the building. (67) "Restaurant - Fast-Food" means a business establishment that offers quick food service, which is accomplished through a limited menu of items alreadv prepared and held for service, or preuared, fried, or 2riddled auicklv, or heated in a device such as a microwave oven. Orders are generallv not taken at the customer's table, and the food is 2enerally served in disposable wrapping or containers. (68) "Restaurant - Sandwieb Limited Service" means a Fast-Food Restaurant that does not frv, broil or griddle anv of its menu items on site, and-whose gross floor area does not exceed 2500 square feet, and that does not have a drive-thru facility. (69) "Review Board" means the Architectural Review Board. (70) "Roadside stand" means a movable structure used or intended to be used solely by the owner or the tenant of property on which it is located for the sale of seasonal agricultural products produced on the premises which shall be removed at the conclusion of the seasonal sales. (71) "Secretary" means the duly acting secretary of the Planning Commission, Board of Zoning Appeals and Architectural Review Board. 9
