accumulate sick leave credits for that period. Empioyees seeking parental leave must notify the <br />Employer three (3) days prior to taking (eave. <br />Section 5. General Leave Provisions; <br />(a) Ail leaves of absences when known in advance (and any extensions thereofl must be applied <br />for and granted in writing on forms provitled by the City (copy to the employee). The emplayee <br />and the Union will be notified within three (3) working days from the date the application was <br />made for approval or tlenial of the requested leave. <br />(b) An employee shall accumulate seniority during any leave of absence, but he shall nat be <br />entitled to any benefits, except that the City shall continue to pay its portion of the employee's <br />haspitalization insurance in Article 19 for a three (3) month period. After the three (3) month <br />period, an employee must direct pay any required hospital/surgicaf premiums to the City on or <br />before the monthly due date. _ <br />(c) When an employee returns to work after a leave of absence, he wilf be assigned to the position <br />which he formerly occupied at the then current rate of pay, or to a similar position if his former <br />pasition no longer exists, if he is physically qualified for the job. In the event the City questions <br />whether the employee is physically able to do the work, the City will require the employee to <br />furnish a City supplied medical certiflcate of a physician supporting his claim of fitness, and the <br />City shall have the right to have the employee examined by a docfor of its choice. If <br />disagreement thereafter exists, a third physician shall be mutually se(ectetl by the Union and <br />the City to determine the issue, and the opinion of the third physician shafl be final on the <br />parties. The charges made by the third physician shall be shared equalfy by the City and the <br />Union. <br />If it is found that a leave of absence is not actually being used for the purpose for which <br />it was granted, the City shall cancel the (eave and it may impose disciplinary action up to and <br />inc(uding discharge. <br />ARTlCLE 12- LAY-OFFS <br />Section 1. Whenever it is necessary for the City to reduce its farces, the employees <br />within the department to be reduced, will be laid off in the following order <br />(a) Students and seasonal employees; <br />(b) Part-time; <br />(c) Employees who have not completed their probationary period; <br />17
