MEMORANDUM OF UNDERSTANDING <br />This Memorandum of Understanding is made this day of <br />2001 between Ohio Council8, American Federation of State, County and <br />Municipal Employees, AFL-CIO and Locai 2681, American Federation of State, County and <br />Municipal Employees, AFL-CIO (hereinafter jointly referred to as "Union") and the City of <br />North Olmsted (hereinafter, "City"). The Union and the City hereby acknowledge the <br />following; <br />1, The Union is certified by the State Employment Relations Board as the exrlusive <br />representative of empioyees of the City in the bargaining unit described in Case Number 85- <br />VR-12-4747; and <br />2. The parties are signatories to a Collective Bargaining Agreement which, at Article 2, <br />Section 1, and Appendix B, sets forth the current classifications represented by the Union in <br />the bargaining unit; and <br />3. The parties are signatories to a Settlement Agreement in Case Number 96-REP-07- <br />0130, previously before the State Employment Relations Board, which provides; a) the <br />classification of Police Secretary I(assigned to the Chief) is deemed to be included in the <br />bargaining uni#; and b) the classification of the Police Secretary (assigned to the <br />Adrninistrative Police Captain) is confidential and appropriately excluded from the <br />bargaining unit; and <br />4. Since the execution of the Settlement Agreement described in item 3, above, the <br />assigned job duties of the Police Secretary (assigned to the Administrative Police Captain) <br />and thejob duties of the Police Secretary I(assigned to the Chieo have changed <br />significantly. The parties agree that the job duties of the Police Secretary (assigned to the <br />Administrative Police Captain) have been significantiy modified so that the classification is <br />no longer confidential. The parties also agree that the Secretary <br />I(assigned to the Chief) is currentiy performing job duties which change the status of the <br />97
